La presente investigación, tuvo como objetivo, identificar como los vicios procedimentales
infieren en la predictibilidad del procedimiento administrativo sancionador por infracciones contra
la ley del patrimonio cultural en la ciudad de Cusco. Para dicho fin se ha hecho uso de la
metodología de tipo básica, con el enfoque cualitativo y el nivel descriptivo. Explicativo. Los
cuales entorno al análisis de la doctrina y las resoluciones emitidas por el Ministerio de Cultura,
ha permitido que se concluya que en el Procedimiento Administrativo Sancionador, existen vicios
que infieren en la predictibilidad del procedimiento en general, actuando como barreras que
impiden que los administrados actúen de una manera conforme a las disposiciones legales, es decir
siguen un procedimiento a la espera de ser eximidos de responsabilidad ya que no existe daño al
patrimonio cultural, pero esto no sucede; puesto que se arriba a un procedimiento sin salida y
sancionable generándose así una afectación a los derechos de los administrados, tal es el caso de
la legalidad, el plazo razonable, y el nem bis in ídem. Ello debido a la magnitud de la sanción. The objective of this research was to identify how procedural defects influence the predictability
of the administrative sanctioning procedure for infractions against the cultural heritage law in the
city of Cusco. For this purpose, the basic methodology has been used, with the qualitative approach
and the descriptive level. Explanatory. Which around the analysis of the doctrine and the
resolutions issued by the Ministry of Culture, has allowed it to be concluded that in the
Administrative Sanctioning Procedure, there are defects that infer in the predictability of the
procedure in general, acting as barriers that prevent those administered They act in a manner in
accordance with the legal provisions, that is, they follow a procedure waiting to be exempted from
responsibility since there is no damage to the cultural heritage, but this does not happen; since it
leads to a dead-end and sanctionable procedure, thus generating an impact on the rights of those
administered, such is the case of legality, reasonable time, and nem bis in idem. This is due to the
magnitude of the penalty.
