Uniformidad de criterios en la calificación registral de las comunidades campesinas.

Abstract

Si bien es cierto existen Leyes, Reglamentos y Directivas que regulan cuales son las formalidades registrales para la adecuada inscripción de los principales actos inscribibles de las comunidades campesinas, se puede observar que en muchas ocasiones no existen criterios uniformes al evaluar los requisitos exigidos por ley.

La presente investigación tiene por objetivo analizar si en la Oficina Registral X Sede Cusco, los Registradores cumplen con evaluar los requisitos y así verificar si existe uniformidad de criterios para la inscripción de la constitución de las comunidades campesinas y sus diferentes actos registrales.

En el Capítulo I desarrollamos los aspectos metodológicos de la investigación, el cual consistió en determinar nuestro planteamiento del problema, y consecuentemente la formulación del problema si en la Oficina Registral X Sede Cusco existe uniformidad de criterios respecto al cumplimiento de los requisitos para inscribir los actos registrales de las comunidades campesinas, así mismo este capítulo contiene el desarrollo de los objetivos planteados para esta investigación y la hipótesis trazada.

Posteriormente, para una mejor comprensión del tema se delimitará conceptualmente a la Persona Jurídica, clases de personas jurídicas, su organización y funcionamiento, así como los miembros que lo integran, su patrimonio, entre otros de relevancia. Asimismo en este Capítulo hace referencia de manera especial a las Comunidades Campesinas, su tratamiento en las diferentes normativas.

El capítulo III referente al Registro de Personas Jurídicas, establece la manera como se organiza el registro, la función que cumple el registro y se desarrolló los diferentes actos que son materia de inscripción dentro del registro de personas jurídicas inscribibles.

En el capítulo IV consideramos importante desarrollar aspectos sobre la Calificación Registral, el procedimiento para lograr la inscripción de los diferentes actos registrales, y establecer las reglas especiales para la calificación de Personas Jurídicas en específico.

El Capítulo V de nuestra investigación se comprobará la hipótesis planteada, la misma que será obtenida producto del análisis y comparación de las esquelas de observación emitidas por los Registradores Públicos.

Finalmente se realiza las Conclusiones y Recomendaciones que se pudieron extraer de este trabajo de investigación, basadas en el análisis de las esquelas de observación.
