Incumplimiento alimentario y la afectación del interés superior del niño respecto del Distrito Fiscal de Cusco, periodo 2021-2022

Abstract

En el presente trabajo de investigación, se ha buscado determinar la protección del interés superior del niño ante el incumplimiento de la obligación alimentaria por parte del obligado respecto del Distrito Fiscal de Cusco, durante el año 2021-2022; además de ello se ha trabajado un análisis sobre el tratamiento por parte de los jueces, en relación a la emisión de sus sentencias penales. En el presente trabajo de investigación tiene un tratamiento averiguativo cualificativo, toda vez que comprende la examinación de fuentes documentales y normas de carácter legal, utilizando diversos criterios, argumentos, técnicas, métodos, que vienen considerando y aplicando, por las autoridades que administran justicia. Así mismo se ha logrado determinar que el propósito de esta investigación es que se garantice el pago de los alimentos, ante el incumplimiento alimentario, más allá de celebrar acuerdos para el pago de los alimentos.

In the present research work, we have sought to determine the protection of the best interests of the child in the event of non-compliance with the maintenance obligation on the part of the obligor with respect to the Fiscal District of Cusco, during the year 2021-2022; in addition to this, we have worked on an analysis of the treatment by the judges, in relation to the issuing of their criminal sentences. This research work has a qualitative investigative treatment, since it includes the examination of documentary sources and legal norms, using different criteria, arguments, techniques, methods, which are being considered and applied by the authorities who administer justice. It has also been determined that the purpose of this research is to guarantee the payment of maintenance in the event of non-payment of maintenance, beyond the conclusion of agreements for the payment of maintenance.
