La función jurisdiccional y la responsabilidad civil de los jueces en el distrito judicial del Cusco 2014 al 2015.

Abstract

La función jurisdiccional es la facultad de administrar justicia, en ese sentido, es el único medio que tiene el Estado para ejercitar el control de legalidad y de legitimidad para la legislación, sin embargo, la actual función jurisdiccional es cuestionada por la actuación de los magistrados, ya sea por errores judiciales, corrupción, falta de especialización, etc. El problema de la labor judicial, es que los justiciables la perciben como deficiente e injusta, oponiéndose en un importante número de casos a las resoluciones judiciales, expresando su disconformidad con lo resuelto por el poder judicial, porque consideran que se vulneraron sus derechos, que los jueces no tomaron decisiones justas o peor aún incurrieron en dolo o culpa inexcusable al momento de dictar sentencias. Es ahí, donde nace la responsabilidad civil de los jueces y los procesos de responsabilidad civil de estos, que están destinados a verificar la labor judicial y que el ciudadano tenga la posibilidad de iniciar un proceso cuando considere que la decisión del juez no se ajusta a la normatividad vigente. La responsabilidad civil de los jueces es un tema que está inmerso en el proceso civil, es decir, es de derecho, tiene una normatividad propia en el código procesal civil peruano vigente y también encontramos el tema de responsabilidad civil como una institución prevista en el código civil tratado específicamente como responsabilidad civil extracontractual. Esta regulación es una importante formalidad, sin embargo, después de varios años de la vigencia del código civil adjetivo; en el terreno de lo objetivo, de lo real, no se conocen públicamente muchos procesos de Responsabilidad Civil de Los Jueces Y En El Distrito Judicial del Cusco , sobre todo en estos dos últimos años 2014 y 2015 no hubo ningún proceso de responsabilidad civil a los jueces, es por eso, que el trabajo de investigación busca encontrar cuales son las razones por la que no se apertura este tipo de procesos y buscar soluciones y respuestas al problema.
