Retroactividad de la pensión para el menor alimentista.

Abstract

El presente trabajo de Investigación está orientado a contribuir con el efectivo cumplimiento del derecho alimentario de los menores alimentistas, que a su vez garantiza derechos fundamentales reconocidos en la Constitución Política como el derecho a la vida, a su integridad moral, psíquica y física, a la igualdad ante la ley y a su libre desarrollo y bienestar, así como velar por el Interés Superior del Niño.

Así mismo, con el presente trabajo de investigación se espera disminuir el incumplimiento de la obligación alimentaria que tienen los irresponsables padres de familia que omiten el deber de brindar asistencia familiar a sus menores hijos y no otorgan una pensión de alimentos sino hasta el momento en que se interpone una demanda en su contra, por lo que los alimentos dejados de percibir por sus menores hijos le salen “gratis”.

La presente investigación, se divide en los siguientes capítulos: El primero, se refiere al problema de investigación, donde: Se ha identificado la problemática, formulado el problema, el objetivo, justificación, metodología del estudio, así como la hipótesis de estudio planteada. El segundo, se desarrolla el análisis teórico y conceptual de la investigación desarrollando ampliamente el tema de Alimentos. El tercero, se refiere al derecho comparado que guarda relación con el tema de alimentos y retroactividad de la pensión alimenticia, comprende también la normativa internacional como tratados internacionales entre otros.

El Cuarto, se refiere al trabajo de campo realizado, específicamente encuestas realizadas a los operadores del derecho conocedores de la materia, también en este capítulo demostrar en representaciones graficas los resultados de la investigación. Así mismo, cuenta con las respectivas conclusiones, recomendaciones y bibliografía.

This research work is aimed at contributing to the effective fulfillment of the alimentary right of food minors, which in turn guarantees fundamental rights recognized in the Political Constitution such as the right to life, moral, psychic and physical integrity, Equality before the law and their free development and well-being, as well as ensuring the best interests of the child.

Likewise, the present investigation is expected to reduce the non-compliance of the food obligation of the irresponsible parents who omit the duty to provide family assistance to their minor children and do not grant a maintenance pension until the moment when A lawsuit is filed against him, so that the food that is not received by his children is “free.“

This research is divided into the following chapters: The first one, refers to the research problem, where: The problem has been identified, formulated the problem, the objective, justification, methodology of the study, as well as the proposed hypothesis of study. The second, develops the theoretical and conceptual analysis of the research developing widely the topic of Food. The third refers to comparative law related to food and retroactivity of maintenance, also includes international law as international treaties, among others. The Fourth, refers to the field work carried out, specifically surveys conducted to the legal operators knowledgeable about the subject, also in this chapter demonstrate in graphic representations the results of the investigation. Likewise, it has the respective conclusions, recommendations and bibliography.
