Gestión y reconocimiento del estado al principio de respeto al uso de agua como derecho humano (Estudio referido en el JASS del Comité de Regantes de Carolina, del distrito y provincia de Calca)

Abstract

La presente investigación, se basa en la observación hecha a la gestión y por ende a los procedimientos administrativos realizados en la toma de decisiones por la Autoridad Nacional del Agua; nos ceñimos como objetivo principal el identificar ¿Cuáles son los factores que dificultan una adecuada gestión en la toma de decisiones y si se han identificado no se aplica de forma efectiva los principios y garantías constitucionales establecidas a través de normas Nacionales e Internacionales al momento de ejecutar la gestión del recurso hídrico y la toma de decisiones; por lo que se estaría vulnerando el adecuado uso al derecho del agua, que es derecho fundamental que se halla en la línea de los derechos humanos . En el desarrollo del trabajo se pudo advertir que tipo de acciones se dieron para la toma de decisiones por parte de la Autoridad Nacional del Agua respecto a la comunidad de campesina de Carolina; ya que tales decisiones fueron sin ser observar las técnicos e instrumentos de gestión adecuados y tampoco se aplicaron las normas y principios constitucionales respecto al uso benéfico y distribución del recurso hídrico de la zona, ello hizo que en la actualidad se haya iniciado una disputa o conflicto respecto al acceso al agua entre el JASS de Carolina, el comité de Riego Carolina y la Junta de Propietarios Virgen de Consevidayoc Antaraccay, pronunciamiento materializado a través de una resolución administrativa que carece de la garantía de motivación que no hizo otra cosa que generar un conflicto social en la zona y por ende generar daños o amenaza irreversible para la satisfacción del recurso hídrico como la disminución en su uso. Es necesario prestar atención en la problemática de la mala aplicación de la gestión en el tema de recursos hídricos para el uso productivo y poblacional que seguramente podría generar más conflictos si no se procura de manera concertada y urgente la elaboración de catálogos actualizados de las zonas hídricas y el comportamiento de las mismas que coincidan al momento de efectuar la visita técnica ente los planos catastrales y los datos almacenados; también observamos que urge la coordinación constante entre los integrantes del sistema hídrico para una mejor gestión al momento de la distribución y autorización de licencias hídricas.

The present investigation is based on the observation of the management and therefore on the administrative procedures carried out in the decision-making process by the State Agency for the Administration of Hydrological Resources (ANA). Our main objective is to identify the factors that hinder the adequate management of decision-making at the time of management. We have also identified that the principles and guarantees established in the Constitution are not effectively applied through national and international norms at the time of executing the management of water resources and decision-making, thus violating the adequate use of the right to water, which is a fundamental right that is found in the line of human rights. In the development of the work, we were able to see what kind of actions were taken by ANA to make decisions regarding the campesino communities of Carolina. These decisions were taken without observing the appropriate technical and management instruments and without applying the norms and constitutional principles regarding the beneficial use and distribution of water resources in the area, which led to the current dispute or conflict over access to water between the JASS of Carolina and the Asociacion Virgen de Consevidayoc. This was pronounced through an administrative resolution, that lacked the guarantee of motivation and did nothing more than generate a social conflict in the area; and thus generating damage or irreversible threat to the satisfaction of the water resource; such as the decrease in its use. It is necessary to pay attention to the problem of the bad application of the management of water resources for productive and population use, which could generate more conflicts; if we do not make a conscious and urgent effort to elaborate updated catalogs of the water zones and their behavior that coincide at the moment of the technical visit between the cadastral plans and the stored data. We also note that there is an urgent need for constant coordination between the members of the water system and for better management at the time of distribution and authorization of water licenses.
