La condena del absuelto en la jurisprudencia y el proyecto de ley 1793-2021-PJ

Abstract

En la presente investigación se plantea como objetivo, analizar la jurisprudencia nacional, internacional y el proyecto de ley Nº 1793-2021-PJ para determinar si el Proyecto de Ley Nº 1793-2021-PJ, resuelve la problemática planteada por la institución procesal de la condena del absuelto. Como metodología se planteó investigación de enfoque cualitativo, tipo de investigación básica y nivel de investigación exploratorio, en cuanto a personas, contamos con 16 participantes entre jueces y fiscales especialistas en derecho penal y procesal penal, así como entre abogados especialistas, quienes fueron encuestados y entrevistados, en referencia al Proyecto de Ley Nº 1793-2021-PJ que habilita a Sala Superior de Apelaciones, Sala Superior Penal Liquidadora, Sala Superior Mixta o Sala Superior de Otra Especialidad para que actúe como órgano revisor, obteniendo como resultado un 50% de la población manifestaron si, un 50% de los encuestados mencionaron no. Respecto al texto sustitutorio del Proyecto de Ley que habilita a la Sala Penal Suprema se obtuvo como resultado como que un 75% de la población manifestaron si resuelve la problemática de la condena del absuelto y un 25% de los encuestados respondieron no, en referencia al órgano revisor de segunda instancia sea otro órgano jerárquicamente superior (Sala Penal Corte Suprema) para satisfacer la pluralidad de instancias, considerando que respecto al Proyecto de Ley originario existe igual de opiniones y respecto al texto sustitutorio la mayoría de la población encuestada considera favorable. Como conclusión, la condena del absuelto fue inserto en el país con la vigencia del Decreto legislativo Nº 957, Código Procesal Penal. Esta regulación carece de una adecuada técnica legislativa debido a que no se acompañó un recurso impugnatorio ordinario para que otra instancia jerárquicamente superior revise ampliamente la sentencia condenatoria, tanto en lo factico, probatorio y jurídico. El proyecto de ley y el texto sustitutorio representan una problemática similar en cuanto afectan el derecho a recurrir a una instancia jerárquicamente superior.

The bill and the substitute text represent a special problem by enabling a review body of the same hierarchy, for which we consider that the right to plurality of instances and the right to appeal are not properly addressed.
