En el ámbito de la Infracción del Plazo Razonable en las Diligencias Preliminares de los
delitos de corrupción de funcionarios de la provincia de La Convención del departamento
del Cusco durante el año 2022, los objetivos planteados son establecer elementos
jurídicos lógicos y fundamentados en relación con el debido proceso y su incipiente plazo
razonable intermitente para monitorear la diligencia preliminar y su formalización de la
investigación preparatoria que excede su plazo con violación de derechos fundamentales
que se encuentran protegidos por la Constitución Política del Perú y sus demás leyes. Por
ello surge el problema actual de la duración del plazo razonable, que no ha sido resuelto
hasta la fecha por ningún órgano competente a pesar de existir guías jurisprudenciales
internacionales que recomiendan su aplicación en sus órganos judiciales.
Asimismo, hacemos énfasis en el tiempo que existe en la sociedad actual, como lo es el
régimen laboral que exige un tiempo de entrada y salida con la producción en el trabajo
y sus diferentes medidas restrictivas que se aplican cuando no es posible sentirse
satisfecho. Como se mencionó anteriormente y a diferencia del debido proceso judicial
con sus plazos previstos en el derecho penal, éste se viola cuando se excede y no hay
respuesta en relación con el responsable de la investigación y reparación del daño causado
al perjudicado. Es por ello que esta investigación profundiza en el complejo período de
la investigación anterior, para alternar otras medidas efectivas y/o simples que no causen
daño a los investigados y al gobierno estatal.
En este sentido, romper la barrera del no tiempo a la que se adhieren muchos doctrinarios;
es recurrente y obligatorio aplicar precedentes vinculantes de la jurisprudencia de
tribunales internacionales en relación con la violación del plazo razonable. Por otro lado, reforzar lo anterior de conformidad con los estándares internacionales existentes que
protegen el correcto funcionamiento de una investigación con conocimiento de cada
Estado Parte, para aplicar ante el órgano judicial nacional del Perú. In the field of the Violation of the Reasonable Period in the Preliminary Proceedings of
the crimes of corruption of officials of the province of La Convencion of the department
of Cusco during the year 2022, the objectives set are to establish logical and founded legal
elements in relation to due process and its incipient intermittent reasonable period to
monitor the preliminary diligence and its formalization of the preparatory investigation
that exceeds its period with violation of fundamental rights that are protected by the
Political Constitution of Peru and its other laws. For this reason, the current problem of
the duration of the reasonable period arises, which has not been resolved to date by any
competent body despite the existence of international jurisprudential guides that
recommend its application in its judicial bodies.
Likewise, we emphasize the time that exists in today's society, such as the work regime
that requires an entry and exit time with production at work and its different restrictive
measures that are applied when it is not possible to feel satisfied. As mentioned above
and unlike due judicial process with its deadlines provided for in criminal law, this is
violated when it is exceeded and there is no response in relation to the person responsible
for the investigation and reparation of the damage caused to the injured party. That is why
this investigation delves into the complex period of the previous investigation, to alternate
other effective and/or simple measures that do not cause harm to those investigated and
the state government.
In this sense, break the barrier of no time to which many doctrinaires adhere; It is recurrent
and mandatory to apply binding precedents from the jurisprudence of international courts in relation to the violation of the reasonable time. On the other hand, reinforce the above
in accordance with existing international standards that protect the correct functioning of
an investigation with the knowledge of each State Party, to apply before the national
judicial body of Peru.
