Eficacia del acta de conciliación extrajudicial en materias civiles obligatorias y su incidencia en la carga procesal en el Primer Juzgado Civil de Cusco, 2021

El siguiente trabajo de investigación se desarrolló bajo el enfoque cualitativo y ha tenido
como finalidad ahondar en la eficacia del acta de Conciliación Extrajudicial de materias civiles
obligatorias para la disminución de la carga procesal en el Primer Juzgado Civil de Cusco en el
año 2021, por lo que se inició con el avance temático de la teoría del conflicto, para continuar con
las MARCS, y centrarnos en los temas principales denominados Acta de Conciliación
Extrajudicial y carga procesal.
Una vez analizada la problemática, surgió el objetivo materia de investigación que se basó
en determinar la eficacia del Acta de la Conciliación Extrajudicial en materias civiles conciliables
obligatorias para la reducción de la carga procesal en el Primer Juzgado Civil de Cusco en el año
2021. Asimismo, se planteó determinar la influencia de las actas conciliatorias extrajudiciales en
el Distrito de Cusco, además de establecer los factores que determinan la variación de la carga
procesal en el Primer Juzgado Civil de Cusco en el año 2021.
Por lo cual se entrevistó a Abogados especializados en materia civil, Conciliadores
Extrajudiciales del Distrito Conciliatorio del Cusco y operadores judiciales del Primer Juzgado
Civil de Cusco, además se analizó informes trimestrales del MINJUSDH; llegando a la conclusión
que el Acta de Conciliación Extrajudicial no tiene mucha influencia en la disminución de la Carga
Procesal en el Primer Juzgado Civil de Cusco, en el año 2021, siendo que dicho documento no
representa un factor determinante para la variación de la carga procesal en la mencionada
dependencia judicial. The following research work was developed under the qualitative approach and its purpose
was to delve into the effectiveness of the Extrajudicial Conciliation Act in mandatory civil matters
for the reduction of the procedural burden in the First Civil Court of Cusco in the year 2021, so it
began with the thematic advancement of the theory of conflict, to continue with the MARCS, and
focus on the main issues called Extrajudicial Conciliation Act and procedural burden.
Once the problem had been analyzed, the research objective arose, which was based on
determining the effectiveness of the Extrajudicial Conciliation Act in mandatory conciliatory civil
matters for the reduction of the procedural burden in the First Civil Court of Cusco in the year
2021. Likewise, it was proposed to determine the influence of the extrajudicial conciliatory acts in
the District of Cusco, in addition to establishing the factors that determine the variation of the
procedural burden in the First Civil Court of Cusco in the year 2021.
Therefore, lawyers specialized in civil matters, Extrajudicial conciliators of the
Conciliatory District of Cusco and judicial operators of the First Civil Court of Cusco were
interviewed, and quarterly reports of MINJUSDH were analyzed, reaching the conclusion that the
Extrajudicial Conciliation Act with agreement does not have much influence on the reduction of
the Procedural Load in the First Civil Court of Cusco in the year 2021, being that this document
does not represent a determining factor for the variation of the procedural load in the mentioned
judicial dependency.
