Factores jurídicos, sociales y económicos que justifican regular el ejercicio de la representación sucesoria por parte del cónyuge supérstite a fin de incorporar un segundo párrafo en el artículo 681 del código civil.

Actualmente en el Derecho Sucesorio peruano, la institución de la representación
sucesoria, regulada en el artículo 681 del Código Civil, faculta su ejercicio a los descendientes en
línea recta ilimitada, y excepcionalmente a los parientes colaterales hasta el segundo grado de
parentesco por consanguinidad; es así que, el legislador y la norma han exceptuado del ejercicio
de la representación sucesoria al cónyuge supérstite, lo cual genera una situación de desigualdad
y desprotección a este último; toda vez que, se ve impedido de recibir la cuota hereditaria que en
vida le hubiera correspondido a su cónyuge premuerto. En ese sentido, el presente trabajo de
investigación tiene como propósito fundamental el de determinar las razones de índole jurídica,
social y económica que justifiquen la regulación y consecuente ejercicio de la representación
sucesoria por parte del cónyuge supérstite; ello a través de una investigación jurídica de tipo
dogmático propositivo de enfoque cualitativo, que implica un amplio análisis doctrinario y
jurisprudencial de las instituciones comprometidas en la presente investigación, conjuntamente
con la aplicación de entrevistas y recolección de información a nivel doctrinario, así como
jurisprudencia y judicial pragmático. Es así que, en base a los resultados y conclusiones obtenidos,
se ha determinado la existencia de dos supuestos de índole jurídico, social y económico, que
motivan facultar al cónyuge supérstite para ejercer la representación sucesoria, a fin de establecer
una propuesta de reforma normativa mediante la cual se adicionará un segundo párrafo al referido
artículo 681° del Código Civil. Currently in Peruvian Succession Law, the institution of Succession Representation,
regulated in Article 681 of the Civil Code, empowers its exercise to descendants in unlimited
straight line, and exceptionally to collateral relatives up to the second degree of kinship by
consanguinity; Thus, the legislator and the rule have exempted the surviving spouse from the
exercise of the Succession Representation, which generates a situation of inequality and lack of
protection for the latter, since he/she is prevented from receiving the inheritance quota that in life
would have corresponded to his/her pre-deceased spouse. In this sense, the main purpose of this
research work is to determine the legal, social and economic reasons that justify the regulation and
consequent exercise of the Succession Representation by the surviving spouse, through a legal
research of a dogmatic-propositional type with a qualitative approach, which implies a broad
doctrinal and jurisprudential analysis of the institutions involved in this research, together with the
application of interviews and collection of information at a doctrinal level, as well as pragmatic
jurisprudence and judicial. Thus, based on the results and conclusions obtained, it has been
determined that there are two cases of a legal, social and economic nature, which motivate the
surviving spouse to exercise the Succession Representation, in order to establish a proposal for a
regulatory reform by which a second paragraph will be added to the referred article 681° of the
Civil Code.
