dc.description.abstract | La presente investigación, tiene como propósito establecer las diferencias que
existen sobre el derecho al acceso a internet, como derecho humano de cuarta generación
en legislación comparada, la necesidad de constitucionalización en el Perú, analizar las
implicancias, jurídicas, económicas y sociales; aborda todos los fundamentos jurídicos
referentes al derecho que tiene la persona al acceso a internet, como derecho fundamental.
La investigación, tiene un enfoque cualitativo, de tipo dogmático comparada, socio jurídica
y el diseño de la investigación es teoría fundamentada. Se empleó la técnica del análisis
documental y la entrevista, como instrumentos, la ficha de análisis documental y
bibliográfica, guía de entrevistas estructuradas, respectivamente. Se ha concluido que el
derecho al acceso al internet fue establecido en algunos estados europeos y de América
Latina, a través de la constitución, otros, por la jurisprudencia, otros mediante leyes, se
encontró diferencias en cuanto al uso del internet en cada país, estableciéndose las zonas
rurales las que se ven más afectadas para gozar de este este derecho universal, sea por
causas de conectividad, geografía o desinterés de las autoridades para ampliar su cobertura;
asimismo, existen suficientes fundamentos jurídicos para constitucionalización en el Perú;
es muy positivo el reconocimiento como derecho fundamental en nuestro país, ya que, trae
aparejado múltiples beneficios en todos los aspectos de la vida humana y el estado peruano,
debe establecer normas que regulen el buen uso, las restricciones, dotar de presupuesto
adecuado para la implementación y garantiza la accesibilidad a internet de forma libre. | es_PE |
dc.description.abstract | The purpose of this research is to establish the differences that exist on the right to access to
the Internet, as a fourth generation human right in comparative legislation, the need for
constitutionalization in Peru, analyze the legal, economic and social implications; It
addresses all the legal bases relating to the right that a person has to access the Internet, as a
fundamental right. The research has a qualitative approach, dogmatic comparative, socio-
legal and the research design is grounded theory. The technique of documentary analysis
and interview was used, as instruments, the documentary and bibliographic analysis sheet,
structured interview guide, respectively. It has been concluded that the right to access the
Internet was established in some European and Latin American states, through the
constitution, others, by jurisprudence, others through laws, differences were found
regarding the use of the Internet in each country, Establishing rural areas that are most
affected to enjoy this universal right, whether due to connectivity, geography or lack of
interest on the part of authorities to expand their coverage; Likewise, there are sufficient
legal foundations for constitutionalization in Peru; Recognition as a fundamental right in
our country is very positive, since it brings multiple benefits in all aspects of human life
and the Peruvian state must establish norms that regulate good use, restrictions, provide an
adequate budget for the implementation and guarantees free Internet accessibility. | en_US |
