Actuación de la justicia ordinaria frente a la aplicación de la justicia comunal en el Perú

Resumen
La presente investigación tuvo como objetivo general el determinar el
argumento desarrollado por el Tribunal Constitucional en la sentencia recaída en el
expediente N° 03158-2018-PA/TC que sirve de fundamento para la creación de la
ley de coordinación entre la justicia ordinaria y la justicia comunal para evitar la
vulneración de hechos vulneratorios a los derechos fundamentales. Para lo cual, se
realizó la búsqueda literaria de conceptos básicos para la presente investigación;
asimismo, el estudio de diversas legislaciones en relación a la ley de coordinación
entre la justicia ordinaria y la justicia comunal para evitar la vulneración de hechos
vulneratorios a los derechos fundamentales. Su realización buscó ampliar una
investigación doctrinal y argumentativa, aplicando un análisis documental con un
diseño hermenéutico y propositivo a través de un proyecto de ley para el contexto
peruano. A partir de los hallazgos encontrados y desde un análisis argumentativo
de los antecedentes y propuestas legislativas de otros países, se concluyó́ que en la
actualidad existe la necesidad de la implementación de la ley de coordinación entre
la justicia ordinaria y la justicia comunal; existiendo las condiciones jurídicas,
sociológicas y antropológicas suficientes como para integrar este nuevo cuerpo
normativo al ordenamiento jurídico peruano. Si bien es cierto se cuenta con el
reconocimiento constitucional de la justicia comunal, en reiteradas ocasiones es este
tipo de administración de justicia la que genera más conflictos, puesto que se ha
visto recurrir a las partes ante la justicia ordinaria después de haberse sometido a la
justicia comunal. El presente estudio permitirá identificar y explicar de manera clara
la actuación de la justicia ordinaria frente a la aplicación de la justicia comunal debido
a que en el Perú se tienen diferentes formas y costumbre en las comunidades
campesinas y; por ende, la forma de la resolución de diferentes conflictos por parte
de los comuneros. The general objective of the present investigation was to determine the
argument developed by the Constitutional Court in the judgment handed down in
case N° 03158-2018-PA/TC that serves as a basis for the creation of the law of
coordination between the ordinary justice and the communal justice to avoid the
violation of facts that violate fundamental rights. For this, the literary search of basic
concepts for the present research was carried out. The study of various laws relating
to the law on coordination between the ordinary justice system and the communal
justice system to prevent violations of fundamental rights. Its realization sought to
expand a doctrinal and argumentative research, applying a documentary analysis
with a hermeneutic and propositional design through a bill for the Peruvian context.
On the basis of the findings and an argumentative analysis of the background and
legislative proposals of other countries, it was concluded that there is currently a
need for the implementation of the law on coordination between the ordinary justice
system and the communal justice system; existing legal, sociological and
anthropological conditions sufficient to integrate this new normative body into the
Peruvian legal system. Although it is true that communal justice is recognized in
the Constitution, this type of administration of justice repeatedly generates more
conflicts, since the parties have been brought before the ordinary courts after having
been brought before the communal courts. The present study will make it possible to
identify and explain clearly the action of the ordinary justice system in relation to the
application of communal justice, given that in Peru there are different forms and
customs in peasant communities; thus, the way of the resolution of different
conflicts by the community members.
