La Escuela Profesional de Derecho de la Universidad Andina del Cusco, tiene
como visión formar profesionales en diferentes áreas y disciplinas, comprometidas con
el desarrollo tanto político como social desde una perspectiva humanística y científica.
Como su misión declara, es importante la formación de recursos humanos orientados a
la investigación que aborde los temas de coyuntura social que vive nuestro país y el
mundo.
Debido a ello, se realizó la presente investigación “La conversión del suelo de
bien propio a bien social a raíz de la declaratoria de fabrica: un análisis del Precedente
de Observancia Obligatoria establecido mediante el pleno CCXX del Tribunal
Registral”.
Este estudio gira en torno a la problemática generada a raíz de los criterios de
interpretación de los artículos 310 del Código Civil y 79 del Reglamento de
Inscripciones del Registro de Predios realizados mediante pleno CCXX por el Tribunal
Registral. A raíz de este pleno se entiende que la declaratoria de fábrica efectuada por la
sociedad conyugal sobre el terreno de uno de los cónyuges supone la conversión en
social de la totalidad del bien inmueble, entendiéndose de esta manera, que se hace
referencia no solo a la edificación sino también al suelo.
En ese sentido, se considera importante analizar los aspectos más relevantes de
dicha interpretación y atender los fundamentos jurídicos considerados por el Tribunal
Registral a fin de poder determinar cuál fue la motivación que contribuyó a tal
conclusión, ya que, en la presente investigación, se considera que, en el supuesto
descrito, se tiene la existencia de dos intereses distintos que requieren una solución
única. Teniendo por un lado el interés del cónyuge que ha adquirido el predio en calidad
de bien propio y consecuente a ello, la protección que requiere su patrimonio individual;
y, por otro lado, tenemos a la sociedad conyugal y a su derecho de tener y poseer un
patrimonio autónomo. The Professional School of Law of the Andina University of Cusco, has as its

political and social development from a humanistic and scientific perspective. In its
mission, it is important to train research-oriented human resources that address the
issues of social situation that our country and the world are experiencing.
Because of this, the present research "The conversion of land from own good to
social good as a result of the factory declaration: an analysis of the Precedent of
Mandatory Observance established by the full CCXX of the Registry Court" was carried
out.
This study revolves around the problem that has been generated as a result of the
criteria for interpretation of articles 310 of the Civil Code and 79 of the Regulation of
Registrations of the Land Registry carried out by the Registry Court through full
CCXX. As a result of this plenary session it is understood that the declaration of factory
made by the conjugal society on the land of one of the spouses supposes the conversion
into social of the totality of the real estate, understood in this way, that reference is
made not only to the building but also to the land.
In this sense, it is considered important to analyze the most relevant aspects of
this interpretation and to attend to the legal bases considered by the Registry Court in
order to be able to determine what was the motivation that contributed to such a
conclusion; because we consider that, in the case described, there are two different
interests that require a single solution. On the one hand we have the interest of the
spouse who has acquired the property as his or her own property and in consequence,
the protection required by his or her individual patrimony; and, on the other hand, we
have the conjugal society and its right to have and possess an autonomous patrimony.
