Flexibilidad laboral y contenido esencial del derecho al trabajo.

Abstract

Nuestra investigación intitulada “FLEXISEGURIDAD LABORAL Y CONTENIDO ESENCIAL DEL DERECHO AL TRABAJO”, ha tenido como norte prever que la probable inserción de mecanismos de flexiseguridad a nuestro ordenamiento jurídico, se realice dentro de los márgenes que establece el contenido esencial del derecho al trabajo, para que sobre la base de esta compatibilidad, no se vulnere en ningún sentido y, por el contrario se procure el máximo desarrollo de sus fines. Simultáneamente, hemos planteado la evaluación reflexiva del marco que nos ofrece nuestra actual legislación laboral, frente a la modernización del Derecho del Trabajo al siglo XXI, que exigen los constantes cambios de la realidad y las necesidades actuales del mercado de trabajo.

Concebir la flexiseguridad como estrategia que concilie ambos aspectos, permitirá una adecuada y efectiva implementación en nuestro país, para ello, se debe configurar un modelo propio, que surja del diálogo social con el Estado y, la participación activa de los sectores de trabajadores, empleadores, autoridades administrativas del trabajo, especialistas y doctrinarios; cuya incorporación sea progresiva en el corto, mediano y largo plazo, para poder verificar el cumplimiento de sus objetivos, y garantizar que no se trate de cualquier otra reforma laboral de corte desregulatorio, sino, sea una verdadera política pública multisectorial que mejore el panorama grave del trabajo en el Perú.

Our research entitled “LABOR FLEXISEGURITY AND ESSENTIAL CONTENT OF THE RIGHT TO WORK“, has had as its goal to predict that the likely insertion of flexicurity mechanisms into our legal system, Is carried out within the margins established by the essential content of the right to work, so that on the basis of this compatibility, it is not violated in any sense and, on the contrary, the maximum development of its aims.

Simultaneously, we have raised the reflexive evaluation of the framework offered by our current labor legislation, as opposed to the modernization of Labor Law to the 21st century, which demand constant changes in the reality and the current needs of the labor market.

To conceive of flexicurity as a strategy that reconciles both aspects, will allow an adequate and effective implementation in our country, for that, it should be configured its own model, that arises from the social dialogue with the State and, the active participation of the sectors of workers, employers , Labor administrative authorities, specialists and doctrinaires; The incorporation of which is progressive in the short, medium and long term, in order to verify the fulfillment of its objectives, and ensure that it is not a question of any other labor reform of a deregulatory nature, but is a true multisectoral public policy that improves the serious panorama Of work in Peru.
