dc.description.abstract | La presente investigación tuvo por objetivo general analizar las principales implicancias negativas
de la Ley N° 31590 (Ley de Tenencia Compartida en el Perú), se postuló como hipótesis general
que, las principales implicancias negativas de la Ley N° 31590 (Ley de Tenencia Compartida en el
Perú) en la protección de los derechos de los niños y adolescentes tras una separación familiar están
relacionadas con el análisis que se debe realizar en cada caso concreto, así como a las medidas a
adoptar para garantizar una distribución equitativa del tiempo y la responsabilidad ente los padres,
en consideración del Interés Superior del Niño y Adolescente y su derecho a la integridad
psicológica y bienestar integral. La investigación fue cualitativa de tipo Jurídico Dogmático-
Analítico, para ello se utilizó las técnicas de recolección de datos fueron: análisis de textos
especializados, de artículos científicos, investigaciones, sentencias emitidas por los Juzgados de
Familia y entrevistas a operadores del derecho, las hipótesis fueron validadas y la conclusión
principal corrobora la hipótesis general en el siguiente sentido que las implicancias negativas son
la vulneración del derecho a la integridad del menor y el Interés Superior del Niño como
consecuencia de la aplicación de la Ley N° 31590 (Ley de Tenencia Compartida) sin realizar un
análisis de cada caso en concreto para la aplicación de la misma, en el entendido que, cada realidad
familiar es distinta tanto en el ámbito económico, psicológico y social.
La recomendación fundamental está dirigida a que los Jueces Especializados en Familia al aplicar
la Ley de tenencia compartida analicen cada caso concreto y no se aplique la misma como regla
general para así salvaguarda los derechos de los niños y adolescentes. | es_PE |
dc.description.abstract | The general objective of this research was to analyze the main negative implications of Law No.
31590 (Shared Tenancy Law in Peru), it was postulated as a general hypothesis that the main
negative implications of Law No. 31590 (Shared Tenancy Law in Peru) in the protection of the
rights of children and adolescents after a family separation are related to the analysis that must
be carried out in each specific case, as well as the measures to be adopted to guarantee an
equitable distribution of time and responsibility. between the parents, in consideration of the
Best Interest of the Child and Adolescent and their right to psychological integrity and
comprehensive well-being. The research was qualitative of a Dogmatic-Analytical Legal type,
for which the data collection techniques were used: analysis of specialized texts, scientific
articles, investigations, sentences issued by the Family Court and interviews with legal
operators, the hypotheses were validated and the main conclusion corroborates the general
hypothesis in the following sense that the negative implications are the violation of the right to
the integrity of the minor and the Best Interest of the Child as a consequence of the application
of Law No. 31590 (Shared Tenancy Law ) without carrying out an analysis of each specific case
for its application, with the understanding that each family reality is different in the economic,
psychological and social spheres.
The fundamental recommendation is aimed at the Specialized Family Judges, when applying
shared possession, analyze each specific case and not apply it as a general rule in order to
safeguard the rights of children and adolescents. | en_US |
