Vulneración al derecho a la identidad por sentencias judiciales en Perú, 2021 - 2023

Abstract

Partimos en reconocer al estado peruano como un estado de derecho, como hombres de derecho estamos en la responsabilidad de hacer respetar, proteger y promover la supremacía de las normas jerárquicas y como ciudadanos estamos en la obligación de cumplir y más aún las leyes naturales y leyes fundamentales. La Constitución consagra el derecho a la identidad, en el Artículo 2°, inciso 1, al prescribir que: “Toda persona tiene derecho: a la vida, a su identidad, a su integridad moral, psíquica y física y a su libre desarrollo y bienestar. El concebido es sujeto de derecho en todo cuanto le favorece”, lo cual singulariza a nuestra legislación frente a otras cuyos ordenamientos jurídicos restringen dicho derecho al individuo ya nacido, los mismos fueron procesados, realizándose conclusiones y tentativas recomendaciones que permitan garantizar, específicamente el derecho a la identidad que se ve afectado cuando es vulnerada por sentencias judiciales sobre cambio de nombre y sexo en los documentos de identificación. Para la investigación tomamos como fuente de estudio las siguientes sentencias judiciales del expediente N° 00088-2021 del año 2021 y el expediente N° 00004-2023-0-1018-JR-CI-01 del año 2023 ambos en materia de cambio de nombre, supresión de nombre y/o adición de nombre y cambio de sexo. En la cual hemos analizado, comprendido, refutado, e interpretado, llegando a la conclusión de que el derecho a la identidad en el Perú es vulnerado por personas que interponen demandas en el poder judicial sobre cambio de nombre y de sexo, casos que nuestro país no regula por considerarse un estado conservador y preservando a no vulnerar el derecho a la identidad en el Código Civil en su artículo 29 que nadie puede cambiar su nombre o hacerle adiciones solo en motivos justificados y con la autorización judicial siempre y cuando este publicada e inscrita.

To achieve the objectives set in the research, we apply documented review techniques; to determine the criteria they have on the topic raised in said study. After the information was investigated, they were processed statistically, making conclusions and attempts that guarantee, specifically, the right to identity that is affected when it is violated by judicial rulings on changing name and sex in identification documents. . For the investigation, we took as a study source the following judicial rulings from file No. 00088-2021 of the year 2021 and file No. 00004-2023-0-1018-JR-CI-01 of the year 2023, both regarding name change. , deletion of name and/or addition of name and change of sex. In which we have analyzed, understood, refuted, and interpreted, reaching the conclusion that the right to identity in Peru is violated by people who file lawsuits in the judiciary regarding name and sex changes, cases that our country It does not regulate, considering it a conservative state and preserving the right to identity in the Civil Code in its article 29, that no one can change their name or make additions only for justified reasons and with judicial authorization as long as it is published and registered.
