dc.description.abstract | La presente investigación tuvo como objetivo general, analizar el incumplimiento de los
derechos laborales de los trabajadores porteadores que realizan su labor en la red de camino inca
por parte de las agencias de turismo e inspecciones de la Sunafil por tanto se realizó la
investigación empleándose el diseño no experimental, de tipo socio jurídico con enfoque
cualitativo.
Es así, que la colecta de la data en cuestión, se realizó una encuesta a 150 porteadores que
realizan su labor en la red de camino inca, a quienes se les pregunto y aplicó los instrumentos de
datos, que recogen información sobre el cumplimiento de la nueva ley de porteadores 31614 por
parte de las agencias de turismo y las inspecciones que realiza la superintendencia nacional de
fiscalización laboral respectivamente.
Estos resultados de la investigación muestran una insatisfacción por parte de los
trabajadores porteadores de la red de camino inca hacia la nueva ley de porteadores 31614 debido
a que las agencias de turismo no cumplen con los requerimientos establecidos dentro de dicha ley
y peor aún, no existe una inspección adecuada por parte de la superintendencia nacional de
fiscalización laboral que permita a los trabajadores porteadores realizar su labor de manera idónea.
Problema: La presente investigación analizó el incumplimiento en la aplicación de la nueva ley
del trabajador porteador 31614 por parte de las agencias de turismo y la inobservancia de los
derechos laborales por parte de la SUNAFIL hacia los trabajadores porteadores de la red de
Camino Inca, problema que aún se puede evidenciar hasta el día de hoy. Objetivo General de esta
investigación fue identificar el incumplimiento de los derechos laborales establecidos en la nueva
ley del porteador 31614 por parte de las agencias de turismo y la entidad de SUNAFIL en el
periodo 2022 al 2023. Métodos: La investigación adoptó un enfoque cualitativo, de tipo Socio
jurídico dado que se abordará un problema social desde una perspectiva jurídica. Se recopilo
información de las agencias de turismo, la SUNAFIL y los trabajadores porteadores de la red de
Camino Inca. Hipótesis: La hipótesis de la investigación fue que las agencias de turismo como la
entidad de SUNAFIL, incumplen lo establecido en la nueva ley del porteador 31614, generando
una vulneración hacia estos trabajadores. Las conclusiones de la investigación fueron: los
trabajadores porteadores tienen un rol fundamental en la red de camino inkas, debido a que son ellos los que tienen contacto directo con los turistas que llegan de muy lejos para ver una de las 7
maravillas del mundo. Es por ello que no podemos dejar de lado las vulneraciones que realizan las
agencias de turismo hacia los trabajadores porteadores más aun teniendo en cuenta que estos son
respaldados por la Nueva Ley del Trabajador Porteador 31614. De otro lado tenemos una entidad
como la SUNAFIL que tiene como función realizar inspecciones para resguardar los derechos de
estos trabajadores, sin embargo, según las entrevistas realizadas a los porteadores, es una función

dc.description.abstract | The general objective of this investigation was to analyze the non-compliance with the
labor rights of the porter workers who carry out their work on the Inca Trail network by the tourism
agencies and inspections of the national superintendency of labor inspection, for which The
research was carried out using a non-experimental design, of a socio-legal type with a qualitative
approach.
To collect the information in question, a survey was carried out on 150 porters who carry
out their work on the Inca Trail network, who were asked and applied the data instruments, which

in an ideal manner.

worker law 31614 by tourism agencies and the non-compliance with labor rights by SUNAFIL
towards the porter workers of the Inca Trail network, problem which can still be seen to this day.
General objective of this research was to identify the non-compliance with the labor rights
established in the new carrier law 31614 by the tourism agencies and the SUNAFIL entity in the
period 2022 to 2023. Methods: The research adopted a qualitative approach, Sociolegal type given
that a social problem will be addressed from a legal perspective. Information was collected from
tourism agencies, SUNAFIL and the porter workers of the Inca Trail network. Hypothesis: The
hypothesis of the investigation was that tourism agencies, such as the SUNAFIL entity, fail to
comply with the provisions of the new carrier law 31614, generating a violation towards these
workers. The conclusions of the research were: porter workers have a fundamental role in the Inca
trail network, because they are the ones who have direct contact with tourists who come from far
away to see one of the 7 wonders of the world. That is why we cannot ignore the violations carried
out by tourism agencies towards porter workers, even more so taking into account that they are
supported by the New Carrier Worker Law 31614. On the other hand, we have an entity like SUNAFIL that has Its function is to carry out inspections to protect the rights of these workers;
however, according to the interviews carried out with the porters, it is a function that this entity
