dc.description.abstract | La ciencia del Derecho penal mediante las teorías de la pena ha buscado elaborar
una fundamentación racional a la intervención punitiva del Estado frente al
ciudadano, cuando éste ha realizado una conducta delictiva. Resultado de esta
monumental labor dogmático-penal, que ocupa siglos, es el nacimiento de
planteamientos como la retribución, la prevención general (negativa), la prevención
general (positiva), la prevención especial y posiciones mixtas.
Todas ellas, encausadas en el propósito de elaborar un esquema de legitimación
para el Derecho penal, incorporaron en sus fundamentaciones ―eso sí, de forma
muy variada― elementos descriptivos, normativos, fácticos, valorativos, entre
otros.
Cada teoría de la pena, puso particular énfasis o atención a uno u otro elemento,
siendo esto, precisamente, aquello que en el tiempo permite diferenciarlas y,
asimismo, reconocer como sus características esenciales.
La irrupción del neokantismo en el Derecho penal, aquella que dota de cientificidad
la labor dogmático-penal, advierte que los ámbitos que le son propios a nuestra
disciplina ―en cuanto ciencia―, lo constituyen únicamente aspectos relacionados
con lo normativo, lo valorativo y lo adscriptivo; situación que obliga
ineludiblemente a revisar y analizar críticamente los postulados que cada una de las
referidas teorías de la pena sostiene.
Asimismo, apreciamos que la estructura vertical conformada por el agente del
delito, la norma jurídica y el Estado es la propia del Derecho penal, lo cual merece ser tenido en cuenta al momento de analizar los fundamentos y relaciones que cada
teoría de la pena presenta frente a dicha estructura; y no solo eso, sino también,
resulta necesario precisar el efecto que produce tal estructura vertical sobre las
teorías de la pena en general.
La presente investigación se dirige a dar respuesta a cada uno de los
cuestionamientos que se advierten, siendo nuestras interrogantes: ¿Qué teorías de
la pena se corresponden con el modelo metodológico neokantiano?, ¿cuáles teorías
de la pena responden a la estructura vertical constituida por el agente del delito, la
norma jurídico-penal y el Estado? y ¿cuál es el efecto jurídico que genera la
estructura vertical constituida por el agente del delito, la norma jurídico-penal y el
Estado sobre las teorías de la pena?, las cuales nos permitirán identificar de mejor
manera los ámbitos que le son propios a nuestro Derecho penal, ello, en cuanto
parte de las ciencias del espíritu. | es_PE |
dc.description.abstract | The science of criminal law, through the theories of punishment, has sought to
elaborate a rational basis for the punitive intervention of the State against the
citizen, when he has committed a criminal conduct. The result of this monumental
dogmatic-penal work, which occupies centuries, is the birth of approaches such as
retribution, general (negative) prevention, general (positive) prevention, special
prevention and mixed positions.
All of them, all aimed at elaborating a scheme of legitimization for criminal law,
incorporated in their foundations ―albeit in a very varied way― descriptive,
normative, factual and evaluative elements, among others.
Each theory of punishment placed particular emphasis or attention on one or
another element, and this is precisely what has made it possible to differentiate them
over time and also to recognize their essential characteristics.
The irruption of neo-kantianism in criminal law, that which endows the dogmatic-
criminal work with scientificity, warns that the areas that are proper to our discipline
-as a science-, are only aspects related to the normative, the valorative and the
ascriptive; a situation that unavoidably obliges to review and critically analyze the
postulates that each of the referred theories of punishment sustains.
Likewise, we can see that the vertical structure formed by the agent of the crime,
the legal norm and the State is the very structure of criminal law, which deserves to
be taken into account when analyzing the foundations and relationships that each
theory of punishment presents in relation to that structure; and not only that, but it is also necessary to specify the effect that such vertical structure produces on the
theories of punishment in general.
The present research is aimed at answering each of the questions that arise, our
questions being: Which theories of punishment correspond to the neo-Kantian
methodological model? Which theories of punishment respond to the vertical
structure constituted by the agent of the crime, the legal-criminal norm and the
State, and what is the legal effect generated by the vertical structure constituted by
the agent of the crime, the legal-criminal norm and the State on the theories of
punishment?, which will allow us to better identify the areas that are proper to our
criminal law, as part of the sciences of the spirit. | en_US |
