Análisis económico del derecho penal y determinación judicial de la pena en sentencias sobre homicidio de la Corte Suprema de Justicia del Perú, periodo 2020 – 2022

Abstract

El presente trabajo de investigación intitulado “Análisis Económico del Derecho Penal y Determinación Judicial de la Pena en sentencias sobre homicidio de la corte suprema de justicia del Perú” y que cuya investigación está referida al periodo de tiempo comprendido entre enero del dos mil veinte a enero del dos mil veintidós, el presente trabajo, tiene como objetivo general el de Determinar la relación que existe entre el Análisis Económico del Derecho y la Determinación Judicial de la Pena en las sentencias sobre homicidio de la Corte Suprema de Justicia del Perú, es por ello que, de ahí surge y se plantea la pregunta general, de: ¿cuál es la relación que existe entre el análisis económico del derecho y la determinación judicial de la pena en las sentencias sobre homicidio de la corte suprema de justicia del Perú?, y a raíz de ello es que se plantea también la siguiente hipótesis: No existe una relación significativa entre el Análisis Económico del Derecho y la Determinación Judicial de la Pena en las sentencias sobre homicidio de la corte suprema de justicia del Perú. Es por ello que la presente investigación, obedece a un diseño Descriptivo Correlacional, ya que la investigación descriptiva es de naturaleza analítica, en la que los estudios en profundidad, y ayudan a recopilar información durante la investigación, y por otro lado, una investigación correlacional se lleva a cabo para medir dos variables, siendo así que como resultado vemos que se corrobora la hipótesis planteada, demostrando que efectivamente, no existe una relación significativa entre el Análisis Económico del Derecho y la Determinación Judicial de la Pena, no obstante no quiere decir que la relación sea nula, es decir, la relación verdaderamente existe, pero corrobora la hipótesis, luego sobre las sentencias de la corte suprema de justicia, nuevamente se corrobora la hipótesis planteada, ya que gráficamente se aprecia que la relación entre las variables no es significativa y que básicamente todo depende de la variable independiente (determinación judicial de la pena) por lo que la otra variable (Análisis Económico del derecho) como su nombre bien lo indica variable dependiente, a esta solo le queda acomodarse a la fluctuación de la variable independiente, y esto se aprecia y queda demostrado gráficamente la superioridad de la variable independiente, sobre la variable dependiente, siendo así que la relación entre ambas no es significativa, más bien es de superioridad y direccionalidad.

That is why this research obeys a Descriptive Correlational design, since descriptive research is analytical in nature, in which in-depth studies help to collect information during the research, and on the other hand, a correlational research It is carried out to measure two variables, and as a result we see that the proposed hypothesis is corroborated, demonstrating that indeed, there is no significant relationship between the Economic Analysis of Law and the Judicial Determination of the Sentence, however it does not mean that the relationship is null, that is, the relationship truly exists, but it corroborates the hypothesis, then on the rulings of the supreme court of justice, the proposed hypothesis is again corroborated, since graphically it can be seen that the relationship between the variables is not significant and that basically everything depends on the independent variable (judicial determination of the sentence) so the other variable (Economic Analysis of the law) as its name indicates the dependent variable, this only has to accommodate the fluctuation of the variable independent, and this is appreciated and the superiority of the independent variable over the dependent variable is graphically demonstrated, the relationship between the two is not significant, rather it is one of superiority and directionality.
