dc.description.abstract | El objeto de la presente investigación lo constituye el literal b del artículo 44 de la
Ley del Impuesto General a las Ventas, aprobado mediate Decreto Supremo N° 055-99-EF,
el cual establece “El comprobante de pago o nota de débito emitido que no corresponda a
una operación real, obligará al pago del Impuesto consignado en éstos, por el responsable
de su emisión. El que recibe el comprobante de pago o nota de débito no tendrá derecho al
crédito fiscal o a otro derecho o beneficio derivado del Impuesto General a las Ventas
originado por la adquisición de bienes, prestación o utilización de servicios o contratos de
construcción. Para estos efectos se considera como operación no real las siguientes
situaciones: (…) b) Aquella en que el emisor que figura en el comprobante de pago o nota
de débito no ha realizado verdaderamente la operación, habiéndose empleado su nombre y
documentos para simular dicha operación. En caso que el adquirente cancele la operación a
través de los medios de pago que señale el Reglamento, mantendrá el derecho al crédito
fiscal. Para lo cual, deberá cumplir con lo dispuesto en el Reglamento”, esta disposición en
otras palabras alude la simulación relativa de operaciones no reales.
Al respecto, en una simulación relativa, la operación si existe, pero quien figura en
el comprobante de pago no es quien realmente lo realizo, habiéndose empleado su nombre,
razón social, razón por el cual no constituye una acción insalvable, sino que procede la
subsanación y convalidación del mismo, en aplicación de algunos principios rectores de la
Administración Tributaria, tal es asi la buena fe y la conservación de las operaciones.
Es precisamente, este extremo que constituye la finalidad de dicha investigación,
otorgando una segunda oportunidad a las operaciones no reales por simulación relativa,

In this regard, in a relative simulation, the operation does exist, but whoever appears
on the payment receipt is not the one who actually performs it, having used his name,
company name, which is why it does not constitute an insurmountable action, but rather the
rectification and validation of the same, in application of some guiding principles of the Tax
Administration, such is the good faith and conservation of operations.
It is precisely this point that constitutes the purpose of said investigation, granting a
second opportunity to non-real operations by relative simulation, as indicated in said
