Pongo en conocimiento el trabajo de investigación intitulado “Cumplimiento de
Obligaciones Laborales en el Caso de la ciudad del Cusco, Periodo 2021”, que tiene como
problema principal ¿Cuál es el nivel de cumplimiento de las obligaciones laborales en el Régimen
Micro y Pequeña Empresa Caso Restaurante Turístico de la ciudad del Cusco, período 2021? El
problema objeto de investigación considera como factor principal describir el cumplimiento de
obligaciones laborales en la micro y pequeña empresa y proponer estrategias que mejoren el nivel
contable – laboral en un caso en particular, así mismo beneficiar tanto a los trabajadores como a
la misma empresa, a fin de garantizar su sostenibilidad.
Es una investigación de tipo básico, enfoque cuantitativo, diseño no experimental
transversal y alcance descriptivo. La población y muestra abarca a toda la empresa, ya que se
consideró toda la documentación laboral durante el año de estudio y así mismo a los 25
trabajadores que la integran. Los resultados a los que se llegó se encuentran debidamente
sustentados con diferentes instrumentos que hemos aplicado, las cuales son: guía de entrevista y
guía de análisis documental, que permitieron la revisión de la documentación contable laboral.
Se concluye que, el nivel del cumplimiento de Obligaciones Laborales se encuentra dentro
de los límites establecidos como aceptable, ya que se tiene un 86% de promedio sobre sus
dimensiones y su semaforización es verde. Así se puede decir que se cumple con las obligaciones
laborales formales en un 85% y que se cumple con las obligaciones laborales sustanciales en un
87%. La empresa cuenta con algunas contingencias laborales y por ende tributarias, ya que existen
25 trabajadores de los cuales deberían mantener contratos indeterminados, según la presunción de
laboralidad; también la empresa debería estar considerada como pequeña empresa en el ámbito
laboral; además realizando un contraste y cruce de información con la Estructura Remunerativa y
las D.J. PLAME, no se considera el total de los ingresos que tienen los trabajadores registrados en
planilla, se declaró y pago erróneamente bajo Bonos de Productividad y Movilidad, como
conceptos remunerativos no computables para el cálculo de aportes y contribuciones, cuando son
consecutivos, recurrentes y fijos y de igual manera no se está cumpliendo con retener a sus
trabajadores la renta de quinta categoría. I report that the research project with the title "Compliance of labor obligations in micro
and small business regime case touristic restaurant of city of Cusco, 2021 period", have as problem:
Which is the compliance level for labor obligations in micro and small business regime case
touristic restaurant of Cusco, 2021 period? The problem subject matter consider as a main fact,
describe the compliance of labor obligations in micro and small business and propose strategies
that improve the accountant - labor level, in a particular case, also, benefit the business and its
workers, looking for the garantee of its sustainability.
Is an basic investigation with cuantitative approach, no experimental transversal design adn
descriptive range. The poblation and sample include all the business, because all the laboral
documentation and 25 employees were considered during the year of investigation.. The results
are explained with differents instruments that were applied, like the interview guide and the
documental analysis guide, that enabled the review of the accountant - laboral documentation.
It is concluded that the level of compliance with Labor Obligations is within the limits
established as acceptable, since there is an 86% average of its dimensions and its traffic lights are
green. Thus, it can be said that formal labor obligations are met by 85% and that substantial labor
obligations are met by 87%. The company has some labor and therefore tax contingencies, since
there are 25 workers of whom must maintain indeterminate contracts, according to the presumption
of employment; The company should also be considered a small business in the workplace; in
addition to carrying out a contrast and cross-checking of information with the Remunerative
Structure and the D.J. PLAME, the total income of the workers registered on the payroll is not
considered, it was incorrectly declared and paid under Productivity and Mobility Bonuses, as noncomputable
