Abstract

La presente investigación titulada “Responsabilidad civil de los operadores judiciales al dictar medidas de protección excediendo el principio de razonabilidad y proporcionalidad”, es finalmente el resultado de un largo trabajo de investigación, ya que hemos podido observar la necesidad de que el Poder Legislativo ponga límites y parámetros a los operadores de justicia al dictar las medidas de protección, En el Capítulo I se desarrolla el planteamiento de la problemática, se explica que en la actualidad en la ley de Violencia Familiar y normas que le antecedieron se ha verificado que no se ha dictado norma que limite al operador judicial al momento de dictar medidas cautelares dentro de ello las medidas de protección que se dictan en los órganos jurisdiccionales, se ha observado ciertos excesos. El objetivo de la presente investigación es ¿Cuál es la responsabilidad civil de los operadores judiciales al dictar en algunos casos, medidas cautelares que no cumple con los principios de proporcionalidad y razonabilidad? En el Capítulo II se desarrolla el marco teórico, donde se abordará aspectos fundamentales y básicos para el desarrollo a profundidad de la presente investigación, tales como antecedentes, bases teóricas, definiciones de términos, entre otros puntos que fueron utilizados como herramientas al momento de habernos proyectado la realización del presente estudio. En el Capítulo III se desarrolla y sustenta la metodología utilizada para el desarrollo de la presente investigación. En el Capítulo IV encontraremos el desarrollo temático, donde abarcamos en sub capítulos la parte doctrinaria Todo ello respaldado en bibliografía, jurisprudencia, así como antecedentes de investigaciones anteriores. En el Capítulo V desarrollaremos los resultados y análisis de los hallazgos que resultan de nuestro desarrollo temático, así como de la realización de una encuesta y análisis, es decir, comprobaremos si el producto de nuestra investigación es conforme a la hipótesis planteada en un comienzo. Finalmente, las conclusiones de la tesis y recomendaciones, así como la bibliografía utilizada y los anexos correspondientes.
