dc.description.abstract | La presente investigación nace a raíz de la desigualdad que se produce por la medida especial de
reposición provisional regulada en el artículo 55 de la Nueva Ley Procesal del Trabajo, que otorga
prioridad algunos supuestos de despido nulo, pero no a todos. En tal sentido el objetivo de la
presente investigación ha sido describir de qué manera la desigualdad de la medida especial de
reposición laboral afecta al derecho del trabajo en el proceso cautelar. Pues, sabemos que todo
trabajador que se encuentra despedido por cualquier motivo ilegal merece una debida protección
por estar en juego derechos constitucionales como es el derecho al trabajo, además del debido
proceso y naturaleza del mismo proceso laboral que es el de tutelar al trabajador por ser la parte
más débil de la relación laboral; sin contar con los derechos que derivan del derecho de trabajo. Es
por ello, la presente investigación tiene una metodología que se aborda con un enfoque cualitativo,
asumiendo el tipo dogmático jurídico. Por tanto, como resultado luego de describir de qué manera
afecta la desigualdad de la medida especial de reposición provisional en el proceso cautelar, y se
concluye en que afecta de manera negativa al derecho del trabajo de aquellos trabajadores
despedidos de manera ilegal que no se encuentran bajo las condiciones que establece el artículo 55
del TUO de la Nueva Ley Procesal del Trabajo; convirtiéndose dicha medida cautelar en un
beneficio solo para un grupo vulnerado en específico. | es_PE |
dc.description.abstract | The present investigation was born as a result of the inequality that is produced by the special
provisional reinstatement measure regulated in article 55 of the New Labor Procedure Law, which
gives priority to some cases of null dismissal, but not to all. In this sense, the objective of this
investigation has been to describe how the inequality of the special measure of labor replacement
affects labor law in the precautionary process. Well, we know that every worker who is fired for
any illegal reason deserves due protection because constitutional rights such as the right to work
are at stake, in addition to due process and the nature of the labor process itself, which is to protect
the worker for being the weaker part of the employment relationship; without counting on the rights
that derive from the right to work. For this reason, the present investigation has a methodology that
is approached with a qualitative approach, assuming the legal dogmatic type. Therefore, as a result,
after describing how the inequality of the special provisional reinstatement measure affects the
precautionary process, and it is concluded that it negatively affects the labor rights of those illegally
dismissed workers who are not present. under the conditions established in article 55 of the TUO
of the New Labor Procedure Law; making said precautionary measure a benefit only for a specific
