dc.description.abstract | El presente trabajo intitulado la prescriptibilidad del cobro de los aportes
previsionales adeudados a las Administradoras Privadas de Fondo de Pensiones (AFPs),
tiene como objetivo analizar las diversas posiciones legales, jurisprudenciales y demás
sobre la prescriptibilidad de los cobros adeudados a las AFPs.
Todo ello debido a que las AFPs acuden al Órgano Jurisdiccional mediante un
proceso ejecutivo en materia de obligación de dar suma de dinero, con la finalidad de
exigir cobros adeudados a los empleadores, siendo el problema fundamental cuando las
AFPs exigen cobros que exceden más de 10 años, generando cobros exorbitantes pues
dentro de dichas deudas también se requiere el pago de los intereses moratorios y las
costas y costos del proceso.
Hecho que a nuestro entender se estaría generando una inseguridad jurídica para
los empleadores - demandados, pues claramente existe una contraposición normativa
entre el artículo 34 del Texto Único Ordenado de la Ley de Sistema Privado de
Administración de Fondo de Pensiones y el inciso 1) del artículo 2001 del Código Civil,
también se puede observar que existe una cierta desigualdad legal en relación al Sistema
Nacional de Pensiones, ya que ambos sistemas tienen la misma finalidad; por ende, según
el Código Tributario estas deudas prescribirían a los 10 años. Asimismo, existirían
diversas posiciones jurisprudenciales que se plasmaron en sentencias contradictorias.
Por lo que, con la presente investigación se pretende, que mediante la
argumentación o apreciación jurídica se dé a conocer argumentos y criterios razonables
y coherentes, con la finalidad de contribuir a que se modifique lo establecido en el último
párrafo del artículo 34 del Texto Único Ordenado de la Ley del Sistema Privado de Administración de Fondos de Pensiones, dando a conocer significativamente las diversas
posiciones y criterios que tiene los magistrados de la Corte frente a este tema.
Pues a nuestro criterio el sustento realizado de las AFPs, sobre la vulneración del
derecho a la pensión, derecho que es de segunda generación, de carácter social; no es
consistente para que no se aplique la prescripción. Por ende, en la presente investigación
daremos puntos o criterios consistentes para que se aplique el plazo de prescripción
señalado en el inciso 1) del artículo 2001 del Código Civil para todos los periodos que
superen dicho plazo antes de la publicación de la Ley Nro. 30425, ya que es obligación
de las AFPs iniciar un proceso ejecutivo en materia de obligación de dar suma de dinero
en un tiempo oportuno.
El primer capítulo de la presente investigación está referido justamente al
problema y los aspectos metodológicos de estudio que contribuirán a que podamos llegar
a nuestra conclusión. En el segundo capítulo nos ocuparemos a desarrollar el marco
teórico, es decir los antecedentes, las bases teóricas, normativas y jurisprudenciales
referente a la seguridad social, a la prescripción y entre otros; asimismo, se desarrollará
las normas que sustentan la prescriptibilidad de los periodos impagos. En el tercer
capítulo desarrollaremos los alcances de estudio, el diseño de investigación se dará a
conocer la población y muestra de nuestra investigación, así como las técnicas e
instrumentos de recolección de datos. En el cuarto capitulo se desarrollará los resultados
y los análisis de los hallazgos, en este capítulo se dará a conocer la manera que se utilizó
los instrumentos de recolección de datos, es decir se dará a conocer las entrevistas
realizadas a los servidoras de la Corte Superior de Justicia de Cusco, posteriormente se
analizar las sentencias que fueron parte de nuestra muestra la cual se citará fundamentos
importantes de cada uno de ellos y por último se realizara cuadros estadísticos
descriptivos. En el quinto capitulo se dará a conocer la comparación critica de resultados con la literatura existente, asimismo; se hará una contrastación de los hallazgos realizados
y por últimos se detallará las limitaciones e implicancias que generó la presente
investigación, todo ello para poder desarrollar nuestras conclusiones y recomendaciones. | es_PE |
dc.description.abstract | The present work entitled the prescriptibility of the collection of pension
contributions owed to the Private Pension Fund Administrators (AFPs), aims to analyze
the various legal, jurisprudential and other positions on the prescriptibility of the
collections owed to the AFPs.
All of this is due to the fact that the AFPs go to the Jurisdictional Body through
an executive process regarding the obligation to pay a sum of money, in order to demand
collections owed to employers, being the fundamental problem when the AFPs demand
collections that exceed more than 10 years, generating exorbitant charges because within
said debts the payment of late interest and the costs and costs of the process are also
required.
Fact that, in our opinion, would be generating legal uncertainty for the employers
- defendants, since there is clearly a regulatory contrast between article 34 of the
Consolidated Text of the Law on the Private Pension Fund Administration System and
subparagraph 1) of article 2001 of the Civil Code, it can also be observed that there is a
certain legal inequality in relation to the National Pension System, since both systems
have the same purpose, therefore, according to the Tax Code, these debts would prescribe
after 10 years. Likewise, there would be various jurisprudential positions that resulted in
contradictory sentences.
Therefore, with the present investigation it is intended that, through legal
argumentation or appreciation, reasonable and coherent arguments and criteria be made
known, with the purpose of contributing to the modification of what is established in the
last paragraph of article 34 of the Single Ordered Text. of the Law on the Private Pension Funds Administration System, significantly publicizing the various positions and criteria
that the Court's magistrates have regarding this issue.
Well, in our opinion, the support made by the AFPs, on the violation of the right
to a pension, a right that is of a second generation, of a social nature; is not consistent so
that the prescription does not apply. Therefore, in the present investigation we will give
points or consistent criteria so that the limitation period indicated in subsection 1) of
article 2001 of the Civil Code is applied for all periods that exceed said period before the
publication of Law No. 30425, since it is the obligation of the AFPs to initiate an
executive process regarding the obligation to give a sum of money in a timely manner.
The first chapter of this investigation refers precisely to the problem and the
methodological aspects of the study that will contribute to our reaching our conclusion.
In the second chapter we will deal with developing the theoretical framework, that is, the
background, the theoretical, regulatory and jurisprudential bases regarding social
security, prescription and among others; Likewise, the rules that support the
prescriptibility of unpaid periods will be developed. In the third chapter we will develop
the scope of the study, the research design, the population and sample of our research, as
well as the data collection techniques and instruments will be disclosed. In the fourth
chapter, the results and analysis of the findings will be developed, in this chapter the way
in which the data collection instruments were used will be disclosed, that is, the interviews
carried out with the servers of the Superior Court will be disclosed. of Justice of Cusco,
later the sentences that were part of our sample will be analyzed, which will cite important
foundations of each of them and finally descriptive statistical tables will be made. In the
fifth chapter, the critical comparison of results with the existing literature will be
announced, likewise; There will be a comparison of the findings made and finally the limitations and implications generated by the present investigation will be detailed, all
