Los criterios negativos de la indebida aplicación de la prisión preventiva en procesados absueltos, en el distrito de Santa Ana, año 2019

Abstract

En el distrito de Santa Anta se viene aplicando indiscriminadamente la disposición de coerción de prisión preventiva que está regulado en el artículo 268º del Nuevo Código Procesal Penal, que pasa, si un ciudadano abusa de su libertad y atenta contra los derechos de los demás, escenario que puede prestarse a malas interpretaciones en nuestra sociedad cuando un tercero llega a estar en el lugar y hora no indicado, por lo que las autoridades entran en acción y toman medidas drásticas para aplacar la conducta irregular del ciudadano y del tercero, pero algunos jueces penales toman criterios negativos para privarles de su libertad, muchas veces llegan a tal decisión por presión social y luego largo y vasto proceso son declarados absueltos por falta de pruebas, por estar en el lugar y hora no indicados, donde el tercer ciudadano queda mellado en su dignidad, honorabilidad y frustrado porque se vulneraron sus derechos fundamentales.

In the district of Santa Anta, the measure of coercion is being applied indiscriminately to preventive detention, which is regulated in article 268 of the New Code of Criminal Procedure, what happens if a citizen abuses his freedom and violates the rights of others , a scenario that can lead to misunderstanding in our society when a third party is in the wrong place at the wrong time, so the authorities intervene and take drastic measures to placate the irregular behavior of the citizen and the third party, but some criminal judges adopt negative criteria for those deprived of their liberty, many times they reach such a decision due to social pressure and then a long and drawn out process is declared acquitted for lack of evidence, for being in the wrong place and time, where the third citizen is slapped in his dignity, honor and frustrated because their fundamental rights were violated.
