El objetivo de la presente investigación fue analizar los factores que inciden en la aplicación de
la ley Nº26979 del procedimiento de ejecución coactiva en la municipalidad distrital de San
Jerónimo, ello teniendo en cuenta que la mencionada ley de ejecución cuenta con un T.U.O y se
aplica sobre los actos administrativos que han adquirido firmeza ello de conformidad con la Ley
Nº27444 – Ley del Procedimiento Administrativo General, al referirse a actos administrativos
se enfoca en resoluciones administrativas que culminan en multas, órdenes de pago, resoluciones
de determinación y otros que son impuestas a los administrados por la omisión o comisión de
no cumplir la normatividad administrativa referida a licencias de funcionamiento, licencias de
construcción, defensa civil, licencias por ocupación de vías públicas, obligaciones tributarias,
etc. Posterior a la emisión de estas sanciones administrativas que adquieren firmeza se hace la
aplicación de la Ley Nº26979 y su T.U.O por la que se aplica la ejecución forzosa e implementa
el inicio de un procedimiento coactivo, una característica especial de este procedimiento es que
durante su tramitación no se puede interponer recursos impugnatorios contemplados en la ley,
toda vez que el tema de fondo se ha deliberado en las unidades de la administración pública que
determinó la responsabilidad administrativa, en tal sentido, su único fin es meramente la
ejecución de la obligación de dar, hacer y no hacer. Sin embargo, se ha podido verificar que en
la mayoría de casos los administrados o contribuyentes recurren a la aplicación del inciso e) del
artículo 16º de la Ley del Procedimiento de Ejecución Coactiva que suspende el procedimiento
coactivo hasta la emisión de una sentencia consentida. También se ha verificado que los
administrados o contribuyentes recurren a la aplicación del artículo 23º del Texto Único
Ordenado de la Ley Nº26979 donde el obligado puede presentar reiteradas veces un mecanismo
procesal denominado Demanda de Revisión Judicial del Procedimiento Coactivo. El efecto de
la presentación de la Demanda de Revisión Judicial y la demanda contencioso administrativa
conlleva a la suspensión del procedimiento coactivo, tan sólo con la presentación al Ejecutor Coactivo del cargo de presentación ante la mesa de partes del Poder Judicial (Sin Auto
Admisorio) con el consecuente levantamiento de las medidas cautelares (Embargos)
debidamente dictadas o emitidas. Observándose, que con este procedimiento se favorecen a los
obligados al poder disponer su patrimonio y transferir sus bienes a fin de evadir la acción de
cobro. Asimismo, se advierte que con estos artículos se genera un perjuicio al estado al evitar la
recaudación de las entidades para cumplir con las necesidades sociales y al suspenderse la
cobranza coactiva por a la interposición de la demanda existen casos en los que no solo se habla
de la recaudación sino también del impacto social debido a la limitación del principio de
autoridad el cual queda limitado en muchos casos perjudicando incluso a la población que se ve
afectada en situaciones como invasiones de vías, áreas verdes o áreas de aporte y que los
procesos judiciales tiene una duración aproximada de 3 a 7 años hasta agotar las instancias
judiciales mientras tanto la infracción sigue subsistentes y el perjuicio sigue ocasionado en la
población y hacia el mismo estado. En la presente investigación se desarrollará sobre los
obligados al presentar sus demandas lo hacen a sabiendas de la carga procesal que tiene el Poder
Judicial y buscan la suspensión del procedimiento coactivo solo con el fin de dilatar y eludir las
sanciones administrativas y obligaciones.
Esta investigación de es de tipo cuantitativo, porque utilizo instrumentos de recolección de datos
que probaran la finalidad del estudio y su relevancia jurídica y aportara a la comunidad jurídica
para la solución a un problema que se ve reflejado en una realidad cotidiana y que es afrontado
por la administración pública. The purpose of the present investigation is to analyze the bills that affect the application of Law
Nº26979 of the coercive execution procedure in the district municipality of San Jerónimo, this
taking into account that the aforementioned law of execution has a T.U.O and is applied to
administrative acts that have become firm in accordance with Law No. 27444 – Law of General
Administrative Procedure, when referring to administrative acts we refer to administrative
resolutions that culminate in fines, payment orders, determination resolutions and others that are
imposed on those administered for the omission or commission of not complying with the
administrative regulations regarding operating licenses, construction licenses, civil defense,
licenses for occupation of public roads, tax obligations, etc. After the issuance of these
administrative sanctions that acquire firmness, the application of Law No. 26979 and its T.U.O
is made, by which the forced execution is applied and the initiation of a coercive procedure is
implemented, a special characteristic of this procedure is that during its processing it is not
possible to file appeals contemplated in the law, since the substantive issue has been deliberated
in the units of the public administration that determined the administrative responsibility, in this
sense, its sole purpose is merely the execution of the obligation to give , do's and don'ts.
However, it has been verified that in most cases the companies or taxpayers resort to the
application of subsection e) of article 16 of the Coercive Execution Procedure Law, which
suspends the coercive procedure until the issuance of a consented sentence. It has also been
verified that the companies or taxpayers resort to the application of article 23 of the Single
Ordered Text of Law No. 26979 where the obligor can repeatedly present a procedural
mechanism called Demand for Judicial Review of the Coercive Procedure. The effect of the
presentation of the Demand for Judicial Review and the contentious-administrative demand
leads to the suspension of the coercive procedure, only with the presentation to the Coercive
Executor of the charge of presentation before the table of parts of the Judicial Power (Without Auto Admisorio) with the consequent lifting of precautionary measures (Embargoes) duly
dictated or issued. Observing that this procedure favors the obligors by being able to dispose of
their assets and transfer their assets in order to evade the collection action. Likewise, it is noted
that these articles cause damage to the state by preventing the collection of entities to meet social
needs and by suspending coercive collection due to the filing of the lawsuit, there are cases in
which we not only talk about the collection but also of the social impact due to the limitation of
the principle of authority which is limited in many cases, even harming the population that is
affected in situations such as road invasions green areas or areas of contribution and that the
judicial processes have an approximate duration of 3 to 7 years until the judicial instances are
exhausted, meanwhile the infraction continues and the damage continues to be caused in the
population and towards the same state. In the present investigation we will develop that those
obliged to present their demands do so knowing the procedural burden that the Judiciary has and
seek the suspension of the coercive procedure only in order to delay and avoid administrative
sanctions and obligations.
This research is of a quantitative type, because it will use data collection instruments that will
prove the purpose of the study and its legal relevance. and will contribute to the legal community
for the solution to a problem that is reflected in a daily reality and that is faced by the public
administration.
