El incumplimiento de las medidas de protección en los casos de violencia intrafamiliar en el distrito de Santiago- 2020.

Abstract

La siguiente investigación tuvo como principal investigación el fin de analizar y describir aspectos fundamentales respecto del incumplimiento de las medidas de protección en la fiscalía de Apoyo de Violencia contra la Mujer e Integrantes del Grupo Familiar en el año 2020, esto con el objetivo de dar a conocer las deficiencias que todavía presenta la Ley 30364 “Ley para Prevenir, Sancionar y Erradicar la Violencia contra las Mujeres e Integrantes del Grupo Familiar. Así también esta investigación sirve para corroborar las causas, consecuencias y motivos por las cuales los denunciados incumplen dichas medidas de protección dictadas por los juzgados de Familia de Cusco, por tal motivo las victimas continúan viviendo en un ciclo de violencia, no logrando salir de ello, ya que muchas de las victimas dependen de su agresor ya sea económica o emocionalmente, siendo un reto alejar a las víctimas de sus agresores, es así que esto nos permite conocer algunos aspectos que influyen en los casos, no siendo un objetivo principal separar familias; si no al contrario esto nos ayuda a reforzar algunos aspectos que están siendo deficientes, para lo cual se realizó la entrevista a los funcionarios públicos quienes laboraron en el Ministerio Publico, para dar fe de lo manifestado en la presente investigación. La presente es uno de los estudios de tipo cualitativo para lo cual se realizó entrevistas para corroborar dicho problema, por lo que la explicación y el estudio se basan justamente en lo mencionado (entrevistas y búsqueda bibliografía) esto nos permite dar credibilidad del fenómeno social que nos atañe. La investigación demuestra que la falta de prevención por parte del estado y la falta de seguimiento a las medidas de protección son una causa principal para el incumplimiento de las medidas de protección.

The following investigation had as its main investigation the purpose of analyzing and describing fundamental aspects regarding non-compliance with protection measures in the Prosecutor's Office for Support of Violence against Women and Members of the Family Group in the year 2020, this with the objective of giving to know the deficiencies that Law 30364 “Law to Prevent, Punish and Eradicate Violence against Women and Members of the Family Group” still presents. Likewise, this investigation also serves to corroborate the causes, consequences and reasons why the accused fail to comply with said protection measures issued by the Family Courts of Cusco, for this reason the victims continue to live in a cycle of violence, not being able to get out of it. Since many of the victims depend on their aggressor, either economically or emotionally, it is a challenge to separate the victims from their aggressors, so this allows us to know some aspects that influence the cases, and separating families is not a main objective. ; If not, on the contrary, this helps us to reinforce some aspects that are being deficient, for which an interview was conducted with public officials who worked in the Public Ministry, to attest to what was stated in the present investigation. This is one of the qualitative studies for which interviews were conducted to corroborate said problem, so the explanation and the study are based precisely on what has been mentioned (interviews and bibliography search), this allows us to give credibility to the social phenomenon that it concerns us The investigation shows that the lack of prevention by the state and the lack of follow-up to the protection measures are a main cause for non- compliance with the protection measures.
