dc.description.abstract | La presente investigación titulada: “El condicionante cultural en el proceso de
elección de las directivas comunales y la acefalía en la representación de las comunidades
campesinas”. Tuvo como objetivo principal conocer cuánto influye el condicionante cultural
en el proceso de elección de las directivas comunales de las comunidades campesinas.
Manifiestamente las Comunidades Campesinas tienen reconocimiento internacional a través
del Convenio 169 de la Organización Internacional del Trabajo (OIT) la misma que
compromete a los Estados que forman parte a respetar sus costumbres. En el Perú, las
comunidades campesinas son personas jurídicas conformadas por familias que comparten
un mismo vínculo ancestral, cultural, social, territorial y económico, cuya organización es
democrática y autónoma, estas cuentan con existencia legal y personería jurídica en virtud
al Art. 89 de la Constitución Política del Perú, asimismo tienen una regulación especial a
través de la Ley Nº 24656-Ley General de Comunidades Campesinas, reglamentada por el
Decreto Supremo Nº 008-91-TR. Apurímac es una de las regiones con más comunidades
campesinas a nivel nacional, donde el 97.1% declararon pertenecer a un pueblo indígena u
originario, conforme a una encuesta realizada por el INEI en el año 2017. Cada dos años se
debe de realizar la renovación de la directiva comunal, para mantener su personería y
capacidad jurídica. Sin embargo, se ha observado que muchas de estas comunidades, cuyo
registro corresponde en la Oficina Registral de Abancay de la Zona Registral N° X, tienen
dificultades en el procedimiento de elección e inscripción de su directiva comunal; estas
dificultades se ven ocasionadas por factores legales, sociales y especialmente culturales, que
inciden en el acto eleccionario, en ese entender ante la solicitud de inscripción de la directiva
electa en Registros Públicos, el procedimiento registral podría concluir en inscripción del
título, esquela de observación o esquela de tacha, de darse la segunda calificación significa
que se tiene que subsanar el título presentado, dilatando el tiempo en el que la comunidad queda sin representación jurídica, y de darse la tercera calificación no se podrá alcanzar la
seguridad jurídica que garantiza la inscripción, que necesita la comunidad campesina para
actuar en el tráfico jurídico y económico, porque al ser el título tachado prolonga el estado
de acefalía de la representación legal, extendiendo los efectos negativos que este genera.
Esta investigación tuvo como hipótesis central que: El condicionante cultural influye
medianamente en el proceso de elección de las directivas comunales de las comunidades
campesinas. Para su corroboración se emplearon instrumentos como entrevistas a los
directamente involucrados en el procedimiento de elección y de inscripción, es decir a
directivos de las comunidades campesinas y registradores públicos de la Oficina Registral
de Abancay; asimismo se realizaron encuestas dirigidas a los registradores de la oficina antes
mencionada; por otro lado, se hizo análisis de las esquelas de tacha del periodo 2021. Lo
mismos que nos permitieron confirmar la hipótesis planteada teniendo como resultado del
estudio que, el condicionante cultural de las comunidades campesinas influye medianamente
en el proceso de elección de sus directivos, ya que en este acto eleccionario algunas
comunidades aplican sus usos y costumbres. En ese sentido se propone que la regulación de
las comunidades campesinas deba hacerse en base y respeto a su derecho consuetudinario. | es_PE |
dc.description.abstract | The present investigation entitled: "The cultural conditioning in the process of
electing the communal directives and the acephaly in the representation of the peasant
communities". Its main objective was to know how much the cultural conditioning
influences the process of electing the communal directives of the peasant communities.
Manifestly, the Peasant Communities have international recognition through Convention
169 of the International Labor Organization (ILO), which commits the States that are part of
it to respect their customs. In Peru, peasant communities are legal entities made up of
families that share the same ancestral, cultural, social, territorial and economic bond, whose
organization is democratic and autonomous, they have legal existence and legal status under
Art. 89 of the Political Constitution of Peru, they also have a special regulation through Law
No. 24656-General Law of Peasant Communities, regulated by Supreme Decree No. 008-
91-TR. Apurímac is one of the regions with the most peasant communities at the national

especially cultural factors, which affect the election act, in that understanding before the
request for registration of the elected directive in Public Registries, the registration procedure
could conclude in registration of the title, notice of observation or esquela de tacha, if the
second qualification is given, it means that the title presented has to be corrected, delaying
the time in which the community is left without legal representation, and if the thi rd
qualification is given, the legal certainty that the registration guarantees cannot be achieved. , which the peasant community needs to act in legal and economic traffic, because being the
crossed out title prolongs the state of acephaly of legal representation, extending the negative
effects that this generates.
This research had as a central hypothesis that: The cultural condition moderately
influences the process of electing the communal directives of the peasant communities. For
its corroboration, instruments were used such as interviews with those directly involved in
the election and registration procedure, that is, directors of the peasant communities and
public registrars of the Abancay Registry Office; Likewise, surveys were carried out directed
at the registrars of the aforementioned office; On the other hand, an analysis was made of
the obituary notices for the period 2021. The same that allowed us to confirm the hypothesis
raised, having as a result of the study that the cultural conditioning of the peasant
communities moderately influences the process of electing their directors, since in this
electoral act some communities apply their uses and customs. In this sense, it is proposed
that the regulation of peasant communities should be based on and respect for their
