Otorgamiento de medidas de protección en los delitos de violencia familiar y la vulneración del derecho de defensa del imputado, durante el primer trimestre del año 2022, en la provincia de La Convención – Cusco

Abstract

En el mundo, los índices de violencia familiar se han incrementado exponencialmente, representando una preocupación cada vez más álgida para los gobiernos, que demandan de acciones eficaces para erradicarla. En Perú, una de estas medidas es la Ley para prevenir, sancionar y erradicar la violencia contra las mujeres y los integrantes del grupo familiar, ley 30364; en la cual se encuentran contenidas las medidas de protección (art. 22º), que a su vez faculta al juez de familia resuelva emitir estas medidas luego de un plazo de 72 horas desde que se interpuso la denuncia, inclusive, sin la presencia de la persona imputada como agresor, dicha situación denotaría una vulneración del derecho de defensa del imputado entre otros constitucionalmente amparados. Ante la realidad expuesta, el presente trabajo de investigación se propuso como objetivo principal establecer en qué medida el otorgamiento de medidas de protección en los delitos de violencia familiar se relaciona con la vulneración del derecho de defensa del imputado, durante el primer trimestre del año 2022, en la provincia de La Convención – Cusco. De acuerdo a los resultados obtenidos, se ha logrado establecer la existencia de una relación alta y significativa (r= 0,841 ** ) entre las variables de estudio. El presente estudio se encuentra conformado por cinco capítulos, distribuidos de la siguiente manera: Capítulo I: Este capítulo presenta la introducción de la investigación, en el podremos encontrar lo relacionado al problema de investigación, la justificación, objetivos, y la delimitación del estudio. Capítulo II: Este capítulo presenta el marco teórico de la investigación, en el podremos encontrar el sustento teórico del mismo, a través de los antecedentes de estudio, las bases teóricas, la definición de términos básicos, el planteamiento de hipótesis y las variables e indicadores. Capítulo III: Este capítulo presenta el método utilizado para el desarrollo de la investigación, en el podremos encontrar apartados como el alcance, el diseño, la población y muestra, las técnicas de recolección de datos con sus respectivos instrumentos, la validez y confiabilidad de los mismos y por último el plan de análisis de datos. Capítulo IV: El presente capítulo presenta los resultados de la investigación, abordando en primer lugar los resultados relacionados a los objetivos específicos, seguidos de aquellos resultados obtenidos respecto al objetivo general de la investigación. Capítulo V: El presente capítulo presenta la discusión de resultados, en el referido capítulo se realizó una descripción de los hallazgos más importantes y significativos en relación al estudio, las limitaciones que se presentaron para su desarrollo, además de un comparativo crítico con lo señalado en la teoría existente, para finalizar se presentan las implicancias del estudio. A modo de colofón del presente trabajo de investigación, se presentan las conclusiones y recomendaciones sugeridas por el investigador, seguidamente se presenta la bibliografía utilizada para el desarrollo integral del trabajo. Finalmente, se indican los anexos que permitieron dar mayor sustento y coherencia al presente estudio.

In the world, the rates of family violence have increased exponentially, representing an increasingly acute concern for governments, which demand effective actions to eradicate it. In Peru, one of these measures is the Law to prevent, punish and eradicate violence against women and members of the family group, law 30364; which contains the protection measures (art. 22º), which in turn empowers the family judge to issue these measures after a period of 72 hours since the complaint was filed, even without the presence of the person accused as the aggressor, such situation would denote a violation of the right of defense of the accused among others constitutionally protected. Given the above reality, the main objective of this research was to establish to what extent the granting of protection measures in family violence crimes is related to the violation of the defendant's right to defense during the first quarter of the year 2022 in the province of La Convención - Cusco. According to the results obtained, a high and significant relationship (r= 0.841**) has been established between the study variables. This study is made up of five chapters, distributed as follows: Chapter I: This chapter presents the introduction of the research, in which we can find what is related to the research problem, the justification, objectives, and the delimitation of the study. Chapter II: This chapter presents the theoretical framework of the research, in which we can find the theoretical support of the research, through the background of the study, the theoretical bases, the definition of basic terms, the hypothesis statement and the variables and indicators. Chapter III: This chapter presents the method used for the development of the research, in which we can find sections such as the scope, the design, the population and sample, the data collection techniques with their respective instruments, their validity and reliability, and finally the data analysis plan. Chapter IV: This chapter presents the results of the research, addressing first the results related to the specific objectives, followed by the results obtained with respect to the general objective of the research. Chapter V: This chapter presents the discussion of results, in which a description of the most important and significant findings in relation to the study, the limitations that were presented for its development, as well as a critical comparison with what is indicated in the existing theory, and finally the implications of the study are presented. As a colophon of this research work, the conclusions and recommendations suggested by the researcher are presented, followed by the bibliography used for the integral development of the work. Finally, the annexes that provided greater support and coherence to the present study are indicated.
