El testamento audivisual como mecanismo eficiente de protección de derechos sucesorios.

Abstract

El presente trabajo investigación se orienta a determinar si la regulación de Testamento Audiovisual es un mecanismo eficiente para salvaguardar y proteger los Derechos Sucesorios, que a diferencia de un testamento convencional no podemos comprobar la verdadera voluntad del testador en un testamento convencional, por escrito. La principal motivación a investigar sobre este tema ha sido impulsar la facción de testamentos, y a consecuencia de ello, de algún modo desahogar la carga procesal que existe en los juzgados por sucesión intestada o declaración de herederos, entonces el uso de la tecnología una vez más abría las puertas a una solución, y de este modo poder crear un testamento audiovisual que no solo fomente la voluntad humana a crear un acto jurídico, testamento, sino a la corroboración de la verdadera voluntad del testador, que puede ser evaluada por la ciencia de la morfopsicología, que estudia de manera muy precisa el comportamiento y carácter de las personas, por medio de la observación del rostro y de elementos que lo componen, y así poder evaluar la última voluntad del testador si es que ella hubiera duda. El estudio ha permitido determinar que la principal razón para la poca realización de testamentos es el excesivo apego a las formas legales. A lo largo de este trabajo se fueron recopilando y adjuntando opiniones de reconocidos autores en materia de acto jurídico, sucesiones, documento electrónico y el estudio de la morfopsicología, así como opiniones sobre la inserción de la tecnología al derecho. Concluyendo en, que el testamento audiovisual es mecanismo eficiente para la protección de Derechos sucesorios y que con el uso de dicho mecanismo se reducirían las controversias Judiciales de herederos en los juzgados, y de este modo abrir posibilidad a una futura regulación del testamento audiovisual.

This research work is aimed at determining whether the regulation of Audiovisual Testament is an efficient way to safeguard and protect inheritance rights, which unlike a conventional testament can not ascertain the true will of the testator in a conventional testament, written mechanism. The study has identified that the main reason for the poor performance of wills is excessive attachment to legal forms. Throughout this paper they were collected and attaching opinions known authors in the field of legal act, inheritance, electronic document and study morphopsychology and views on the inclusion of the right technology. I conclude that the audiovisual testament is efficient for inheritance rights protection mechanism and legal disputes in courts heirs would be reduced, and thus open possibility for future regulation of audiovisual testament.
