dc.description.abstractDe la investigación realizada, con respecto al tema de sistema jurídico se observó que los principios rectores del Derecho Tributario son: deber de contribuir, igualdad, capacidad contributiva y legalidad o reserva de ley, esta última entendida, que solo a través de la ley se puede crear modificar y extinguir los tributos, además que sirven como límite de actuación de la administración tributaria con respecto a sus funciones y a imponer sanciones a los administrados. Con respecto a la elusión, que tiene como antecedente una regulación por más de 100 años en los distintos estados de Europa y parte de América, donde existen diferencias claras de elusión con evasión fiscal, siendo la primera actos utilizados para disminuir o desgravar los actos económicos a través de la utilización de los negocios anómalos. Es más, en nuestro país como antecedente más remoto está la Norma VIII del Título Preliminar del Código Tributario que fue modificado con relación a su carácter elusivo, ahora en la actualidad la Norma XVI del mismo cuerpo normativo tiene un carácter de norma antielusiva general que es cuestionada por infringir el principio de seguridad jurídica, al utilizar terminología que genera confusión e inseguridad con respecto a los alcances conceptuales que tendrían al momento de ser utilizadas por parte de la administración tributaria, siendo necesario por eso su reglamentación de manera urgente antes de ser aplicada. Hay que tener en cuenta que, la reglamentación por parte de la SUNAT con respecto a la Norma XVI del Código Tributario se viene esperando por más de dos años, desde que se dio la suspensión de esta, si bien, se tiene normas de carácter específico que solucionen casos en temas elusivos, estos no tienen la eficacia para poder combatir todos los supuesto elusivos utilizados por los contribuyentes que afecta directamente en los niveles de recaudación de nuestro país.es_PE

Keep in mind that regulation by the SUNAT regarding Rule XVI of the Tax Code has been waiting for more than two years since the suspension of this was given, although it has rules specific character They solve cases that elusive subjects, they do not have the efficiency to combat all elusive course used by taxpayers that directly affects the collection levels of our country.en_US
