Falta de regulación de cuestiones específicas respecto al teletrabajo en la legislación peruana actual y la consecuente vulneración de los derechos laborales de los teletrabajadores

Abstract

La presente tesis titulada “Falta de regulación de cuestiones específicas respecto al teletrabajo en la legislación peruana actual y la consecuente vulneración de los derechos laborales de los teletrabajadores”, se desarrolló con el objetivo principal de, analizar de qué manera la falta de regulación de cuestiones específicas respecto al teletrabajo, en la legislación peruana actual, vulnera los derechos laborales de los teletrabajadores. De esta manera, la metodología utilizada para la realización de esta tesis, fue una metodología de naturaleza cualitativa, es decir que esta tesis se basó en la interpretación y análisis del texto normativo, fuentes bibliográficas, y opiniones de expertos acerca del tema. El escenario de estudio, de esta investigación, se sitúa en Perú en la actualidad, es decir en el tiempo posterior al inicio de la crisis sanitaria del COVID 19, y de la aprobación de las políticas y decretos de urgencia sobre el teletrabajo, dictadas por el gobierno durante esta cuarentena. Debido a la naturaleza cualitativa de esta investigación, la unidad de estudio del mismo, está conformada por, textos de investigación y normativos referidos a la regulación legal del teletrabajo tanto en el ámbito nacional como internacional, y entrevistas a expertos en el tema, es decir docentes universitarios y autores con conocimiento sobre el derecho laboral y la regulación del teletrabajo en la legislación peruana actual. Las técnicas de investigación utilizadas fueron, el análisis de textos y entrevistas, mediante el uso de, textos, fichas de análisis de texto, fichas comparativas y preguntas de entrevista. Finalmente, esta investigación dio como conclusión que, la falta de regulación de cuestiones específicas respecto al teletrabajo en la legislación peruana actual, vulnera los derechos laborales de los teletrabajadores de manera indirecta, ya que al no existir una regulación de aquellas cuestiones que implican el ejercicio del teletrabajo, los derechos laborales que protegen a los teletrabajadores de dichas cuestiones, pueden ser completamente ignorados al momento de llevar a cabo el teletrabajo.

This thesis entitled “Lack of regulation of specific issues regarding teleworking in current Peruvian legislation and the consequent violation of the labor rights of teleworkers“, was developed with the main objective of analyzing how the lack of regulation of issues specific regarding telework, in the current Peruvian legislation, violates the labor rights of teleworkers. In this way, the methodology used to carry out this thesis was a methodology of a qualitative nature, that is, this thesis was based on the interpretation and analysis of the normative text, bibliographic sources, and expert opinions on the subject. The study scenario of this research is currently located in Peru that is, in the time after the start of the COVID 19 health crisis, and the approval of the emergency policies and decrees on teleworking, dictated by the government during this quarantine. Due to the qualitative nature of this research, its study unit is made up of research and regulatory texts referring to the legal regulation of teleworking both nationally and internationally, and interviews with experts on the subject, that is, university professors and authors with knowledge about labor law and the regulation of teleworking in current Peruvian legislation. The research techniques used were the analysis of texts and interviews, through the use of texts, text analysis sheets, comparative sheets and interview questions. Finally, this research concluded that the lack of regulation of specific issues regarding teleworking in current Peruvian legislation violates the labor rights of teleworkers indirectly, since there is no regulation of those issues that involve the exercise of teleworking, the labor rights that protect teleworkers from such issues can be completely ignored at the time of teleworking.
