dc.description.abstractLa institución de la Prueba Trasladada, no se encuentra regulada en el NCPP del 2004, pero si lo está en el art. 20° de la Ley N° 30077, esta ley, autoriza trasladar pruebas documentales, admitidas o actuadas, solo en los procesos de Crimen Organizado, sin embargo, surge la interrogante del autor, existe o no la posibilidad de que esta institución también pueda ser aplicada a la Declaración del Imputado. Ya que, en la referida ley, no está regulado o menos autoriza su aplicación a pruebas personales. Con la presente investigación el autor pretende determinar de qué es eficaz aplicar la Prueba Trasladada a la Declaración del imputado en el proceso de Crimen organizado, debido a que existe referencia positiva en un proceso judicial, en el Exp. Judicial N°. 001967-2016-70-2701-JR-PE-03. (Caso N° 3606015600-2016-47-0), tramitado en el 1° JIP de Tambopata de la CSJMDD, en el cual se aplicó al amparo del Principio de Libertad Probatoria. Asimismo, se pretende establecer de que existen razones de índole procesal para justificar una propuesta legislativa, para que esta institución procesal pueda ser regulada taxativamente en el art. 20 de la Ley. N° 30077, Ello hace entrever de que coadyuvará la labor de investigación del Fiscal en poder identificar a los integrantes y lograr desarticular la Organización Criminal, al Juez a tener criterios de valoración sobre la Prueba Traslada de conformidad a lo establecido en el art. 158 del NCPP del 2004. Por tanto, el autor considera que, si es posible aplicar, siempre en cuando la deposición brindada por el imputado en el proceso de origen, se haya recibido con todas las garantías de ley, para que en el proceso receptor al que se desea trasladar tenga la misma eficacia y validez como Prueba Trasladada.es_PE
dc.description.abstractThe institution of Transferred Evidence is not regulated in the 2004 NCPP, but it is in art. 20 ° of Law No. 30077, this law authorizes the transfer of documentary evidence, admitted or acted, only in Organized Crime processes, however the author's question arises, whether or not there is the possibility that this institution can also be applied to the Declaration of the Defendant. With the present investigation, the author intends to determine that it is effective to apply the Transferred Evidence to the Declaration of the accused in the Organized Crime process, because there is a positive reference in a judicial process, in Judicial File No. 001967-2016-70-2701-JR- PE-03. (Case N ° 3606015600-2016-47-0), processed in the 1st JIP of Tambopata of the CSJMDD, in which it was applied under the Principle of Probation. Likewise, it is intended to establish that there are procedural reasons to justify a legislative proposal, so that this procedural institution can be exhaustively regulated in art. 20 of Law No. 30077, This suggests that the investigative work of the Prosecutor will help to identify the members and achieve dismantling the Criminal Organization, the Judge to have assessment criteria on the Transferred Evidence in accordance with the provisions in art. 158 of the 2004 NCPP. Therefore, the author considers that, if it is possible to apply, as long as the deposition provided by the accused in the origin process, has been received with all the guarantees of the law, so that in the receiving process the that you wish to transfer has the same effectiveness and validity as the Transferred Evidence.en_US
