El órgano instructor en el procedimiento administrativo disciplinario según la ley del servicio civil

Abstract

La investigación denominada “EL ÓRGANO INSTRUCTOR EN EL PRODEDIMIENTO ADMINISTRATIVO DISCIPLINARIO SEGÚN LA LEY DEL SERVICIO CIVIL” tiene su génesis en la problemática jurídico-social que hay en los procedimientos administrativos disciplinarios (PAD) en las instituciones públicas de nuestro país, razón por la cual se vulnera una variedad de derechos fundamentales y en base a ello, en la presente investigación se realizó un estudio exhaustivo con la finalidad de re-examinar la Ley y a fin de darle un tratamiento mejorado. En el Capítulo I de la presente investigación se desarrolla el planteamiento del problema; asimismo, la formulación del problema y los objetivos de la investigación. En el Capítulo II de la presente investigación se desarrolla el marco teórico; asimismo, las bases teóricas y el marco legal y jurisprudencial. En el Capítulo III de la presente investigación se desarrolla el diseño metodológico, sub-dividido en diseño contextual, escenario, tiempo y coyuntura, a su vez, la unidad de estudio. En el Capítulo IV de la presente investigación se desarrolla los resultados y análisis de los hallazgos, asimismo; la discusión y contrastación teórica de los hallazgos.

The investigation called “THE INSTRUCTIONAL BODY IN THE DISCIPLINARY ADMINISTRATIVE PROCEDURE ACCORDING TO THE CIVIL SERVICE LAW“ has its genesis in the legal-social problems that exist in the disciplinary administrative procedures (PAD) in the public institutions of our country, which is why A variety of fundamental rights are violated and based on this, in this investigation an exhaustive study was carried out in order to re-examine the Law and in order to give it an improved treatment. In Chapter I of this research the problem statement is developed; likewise, the formulation of the problem and the objectives of the investigation. In Chapter II of this research the theoretical framework is developed; likewise, the theoretical bases and the legal and jurisprudential framework. In Chapter III of this research, the methodological design is developed, sub-divided into contextual design, setting, time and conjuncture, in turn, the unit of study. In Chapter IV of the present investigation the results and analysis of the findings are developed, likewise; the theoretical discussion and contrasting of the findings.
