Estereotipos de género y las máximas de experiencia en los delitos de violación sexual (en el Distrito Judicial de Cusco, 2017-2020)

Abstract

Los estereotipos de género en el plano jurídico han cobrado notoriedad a raíz de polémicos fallos de magistrados, los cuales se hayan mimetizados a través de la aplicación de las máximas de la experiencia. Y al tratarse delitos tan delicados, como son los de violación a la libertad sexual, cuyas víctimas suelen ser mujeres cuyos roles de género están tan arraigados y aún predomina el machismo y la misoginia en la sociedad, es aberrante encontrar barreras judiciales que cuestionan el actuar y el modo de vestir de la víctima, y lejos de encontrar la tan ansiada justicia, vulneran el debido proceso, la tutela judicial y logran revictimizar aún más a la víctima. La presente investigación aborda esta problemática, teniendo como muestra las sentencias judiciales referentes a este delito correspondiente a los años 2017-2020 de la Corte Superior de Justicia de Cusco, a través de cinco capítulos los cuales han sido desarrollados bajo la siguiente estructura. El primer capítulo contempla la introducción, y despliega el problema y los objetivos de investigación, ello bajo las razones en las que se justifica y delimita nuestra investigación. El segundo capítulo desarrolla el marco teórico, los antecedentes de la investigación, las bases teóricas y la hipótesis de trabajo, así como las categorías de estudio. El tercer capítulo establece el método sobre el cual se desarrolló el presente trabajo de investigación. El cuarto capítulo, denominado desarrollo temático, contempla subcapítulos en función a las categorías de estudio, en el presente trabajo de investigación se cuenta con dos subcapítulos, el primero denominado máximas de las experiencia y el segundo estereotipos de género; ambos subcapítulos abarcan definiciones, origen, tipología, funciones, teorías, sistemas, fuentes, el rol del estado frente a los estereotipos de género en el plano jurídico, como aborda el Poder Judicial esta problemática mediante legislación internacional, y las consecuencias jurídicas que desencadena la problemática abordada. Y finalmente el quinto capítulo, denominado resultados y análisis de los hallazgos, contempla el procesamiento, análisis y discusión de los hallazgos obtenidos.

Gender stereotypes present within the legal system have gained notoriety as a result of controversial judges' rulings, which have been camouflaged through the application of the maxims of experience and when dealing with crimes as delicate as rape of sexual freedom. Victims are often women whose gender roles are so ingrained and still predominate the machoism & misogyny that persists in society. It is aberrant to find barriers that question the actions and the way the victim is dressed, and far from finding the long-awaited justice, by violating due process and judicial protection it only manages to further victimize the victim. Present research addresses this problem; taking as a sample the judicial rulings regarding a crime of this nature; that correspond to the years 2017-2020 of the Court Superior of Justice of Cusco, through five chapters which have been developed under the following structure. The First chapter contemplates the Introduction, and unfolds the problem and the objectives of investigation; this underlines the reasons in which our investigation is justified and delimited. The Second chapter develops the theoretical framework, the background of the research, the theoretical basis and working hypotheses, as well as the study categories. The Third chapter establishes the method on which the present research work was developed. The Fourth chapter, called Thematic Development, includes subchapters based on the categories of Study. Within this research work there are two subchapters: the first called Maxims of Experience and the second Gender Stereotypes. Both of these subchapters contain further subchapters covering definitions of Origin, Typology, Functions, Theories, Systems, Sources, the Role of the state in the face of gender stereotypes within the legal system, the problem as addressed by the Judiciary through international legislation, and the legal consequences that are triggered by the addressed problem. And finally the Fifth chapter, called Results.
