dc.description.abstract | El presente trabajo de investigación tuvo como objetivo general determinar cuál de las
partes del procedimiento administrativo de protección al consumidor se ve beneficiada
en mayor medida con la introducción de la figura del allanamiento al Código de
Protección y Defensa del Consumidor. Ésta investigación fue de tipo básica, de nivel
exploratorio y el enfoque cualitativo. Las conclusiones fueron las siguientes: De las
partes del procedimiento administrativo de protección al consumidor quién se beneficia
en mayor medida con la figura del allanamiento administrativo del Código de Protección
y Defensa del Consumidor es el proveedor, porque aun cuando la norma establece que
la amonestación es solo una posibilidad, la práctica administrativa la ha convertido en la
regla general y porque existe más posibilidad que sea exonerado del pago de costos al
consumidor. Los efectos que genera el allanamiento administrativo en los
procedimientos administrativos de protección al consumidor respecto al consumidor son
que: en la mayoría de casos no es compensado por los gastos incurridos en honorarios
profesionales de su abogado, existe una mediana posibilidad de que la medida correctiva
solicitada sea ordenada y no garantiza un procedimiento célere. Los efectos que genera
el allanamiento administrativo en los procedimientos administrativos de protección al
consumidor respecto al proveedor son que: en la mayoría de casos es sancionado con
una amonestación, es exonerado del pago de costos al consumidor, no tendrá
necesariamente que cumplir la media correctiva solicitada por el consumidor y no le
garantiza un procedimiento célere. | es_PE |
dc.description.abstract | The general objective of this research work was to determine which of the parties in the
administrative procedure for consumer protection is the most benefited with the introduction
of the figure of the Allanamiento on the Consumer Protection and Defense Code. This
research was of a basic type, exploratory level and qualitative approach. The conclusions
were the following: Of the parts of the administrative procedure for consumer protection,
