Los incendios forestales, la conducta del menor infractor y la justicia juvenil en el Perú

Abstract

La presente tesis toma en manifiesto la problemática que recae los incendios forestales, la conducta del menor infractor y la justicia juvenil en el Perú. Trabajo de investigación en el que se da a conocer la comisión del ilícito en el que los menores de edad queman generando consecuencias adversas contra el medio ambiente. Es así que se atenta contra el ecosistema. Si bien la actividad del quemado de restos vegetales tiene origen ancestral, este durante mucho tiempo es utilizado con fines diversos, en muchos casos carentes de razonamiento. Los cuales tienen como matiz de realización el perpetrado por los menores de edad. Factores que traducen un aspecto importante para el ámbito regulatorio punitivo, ya que tras la dación de la norma que regula la delincuencia juvenil, se pudo prever en concordancia con el código de los niños y adolescentes, que las medidas tomadas a cabo a aquellos menores que cometen ilícitos, configurándose así en torno a ello el mecanismo cualificado de las infracciones. Es así que se cuestiona la falta de una unidad especializada en materia ambiental en la Prov. De la Convención y en gran parte de nuestro Perú por parte de la policía Nacional del Perú, ya que ellos son los encargados de las diligencias preliminares en materia de investigación junto con el Ministerio Publico quienes están a cargo de las investigaciones y si se identifica proceder a denunciarlos. y se propone (que se aplique le ley de los Niños y adolescentes más drásticamente, porque en su condición de inimputables es que los adultos trasladas esa responsabilidad los menores infractores, por parte del Estado se debería cobrar una reparación Civil a los causantes de estos siniestros ya sean menores de edad o mayores de edad, sancionarlos ejemplarmente para que si de alguna manera se mitigue estas malas prácticas, costumbres ancestrales, o por desconocimiento de las sanciones penales Qué se propone y con qué fin) y finalmente se concluye con la propuesta de se aplique de manera más acertada y consensualmente la aplicación del código del niño y del adolescente con el objeto de reducir, mitigar los incendios forestales, y también se reduciría de alguna manera significativa la contaminación ambiental a través de estos incendios en el departamento del cusco, y así también reducir estos incendios en gran parte del Perú, y de alguna otra manera se logré cobrar alguna reparación civil hacia el estado por parte de los que cometen estos ilícitos penales.
