La regulación ambiental y su incidencia en la dinámica de producción minera: Caso de la región Cusco, 2009-2019

La minería tiene un rol especialmente importante en la región del Cusco donde se estima que
la minería contribuye al 16% del PBI. Sin embargo, el fin del superciclo de commodities ha
forzado al gobierno a tomar medidas pro-crecimiento económico. Una de ellas fue la
promulgación de la Ley 30230 que le quitó al Organismo de Fiscalización y Evaluación
Ambiental (OEFA) la facultad de sancionar con multas a minas infractoras de las
regulaciones ambientales. El presente estudio tiene como objetivo determinar el efecto de
una menor regulación ambiental en la dinámica de producción minera para el período 2009-
2019. La investigación tiene un alcance explicativo, con un diseño correlacional y un
enfoque cuantitativo. Se emplea información del reporte de producción minera del
Ministerio de Energía y Minas, indicadores de desarrollo del Banco Mundial y el reporte de
mercados de Commodities del Banco Mundial, con una muestra de 160 observaciones por
minera-año. El análisis utiliza un modelo de series de tiempo interrumpido para identificar
el efecto de la promulgación de la Ley 30230 en la dinámica de producción de Plata, Cobre
y Oro en Julio del 2014. Los resultados sugieren que una menor fiscalización por parte de
OEFA y una menor regulación ambiental tuvo efectos positivos en la producción. Los
resultados son estadísticamente significativos con un p-valor entre 0.10 y 0.01. Se encuentra
que la producción de plata y cobre se incrementa en 2,332 kilogramos finos y 135,124
toneladas finas respectivamente después de la promulgación de la Ley 30230, a costa de una
mayor contaminación ambiental en la región del Cusco. Mining plays an especially important role in the Cusco region where it is estimated that
mining contributes to 16% of GDP. However, the end of the commodities supercycle has
forced the government to take pro-economic growth measures. One of them was the
enactment of Law 30230, which removed the Environmental Inspection and Evaluation
Agency (OEFA) from the power to sanction mines that violate environmental regulations
with fines. The objective of this study is to determine the effect of less environmental
regulation on the dynamics of mining production for the period 2009-2019. The research has
an explanatory scope, with a correlational design and a quantitative approach. Information
is used from the mining production report from the Ministry of Energy and Mines,
development indicators from the World Bank and the Commodities markets report from the
World Bank, with a sample of 160 observations per mining company-year. The analysis uses
an interrupted time series model to identify the effect of the enactment of Law 30230 on the
dynamics of Silver, Copper and Gold production in July 2014. The results suggest that less
oversight by OEFA and a less environmental regulation had positive effects on production.
The results are statistically significant with a p-value between 0.10 and 0.01. It is found that
the production of silver and copper increased by 2,332 fine kilograms and 135,124 fine tons
respectively after the enactment of Law 30230, at the cost of greater environmental pollution
in the Cusco region.
