Cuál es el nivel de eficacia del artículo 311 del código penal frente a la utilización indebida de tierras agrícolas en el distrito de San Sebastián departamento del Cusco periodo 2019

Abstract

El objetivo de la investigación consiste en determinar el CUAL ES EL NIVEL DE EFICACIA DEL ARTÍCULO 311 DEL CÓDIGO PENAL FRENTE A LA UTILIZACIÓN INDEBIDA DE TIERRAS AGRÍCOLAS EN EL DISTRITO DE SAN SEBASTIÁN DEPARTAMENTO DEL CUSCO PERIODO 2019. La importancia del medio ambiente es fundamental para mantener todo tipo de vida que en él se encuentra y principalmente para el hombre, ya que el medio ambiente le proporciona los recursos necesarios para que pueda satisfacer sus necesidades básicas. El ser humano debe ser más racional y saber administrar los recursos que la naturaleza le brinda, ya que producto de la contaminación ambiental y la mala práctica de la sociedad de no respetar el entorno donde vive está poniendo en riesgo dichos recursos, cuyos daños causados en un futuro no muy lejano serán irreparables. La responsabilidad ambiental tiene por objeto obligar al causante ya sea una persona natural o jurídica de reparar los daños causados al medio ambiente a pagar la reparación de tales daños originados por su actuar. Se logró evidenciar que en el distrito de San Sebastián el proceso de urbanización aumento de una forma muy acelerada lo cual, sino se realiza un proceso de urbanización adecuado respetando parámetros establecidos, esto generara impactos negativos en dicho Distrito. Una consecuencia negativa del crecimiento urbano es la superpoblación y agotamiento de recursos naturales, lo cual es producto de una mala distribución del territorio. Se pudo observar que el área agrícola disminuyo notoriamente en los últimos años, generado por el crecimiento urbanístico descontrolado, el desconocimiento por parte de las personas, la mala práctica de nuestra sociedad de no respetar las normas ambientales y penales, hace que este tipo de problemas surja, también este problema se da por el desinterés de las autoridades competentes encargadas de proteger y velar por la protección de este tipo de tierras que son de suma importancia para el ser humano. En conclusión, esta investigación permitirá generar información precisa y actualizada para elaborar propuestas concisas y viables en el ámbito de la sostenibilidad ambiental y territorial del Distrito de San Sebastián departamento del Cusco. Así como, difundir la importancia y el valor económico que posee este tipo de tierras destinadas a la actividad agrícola, lo cual, sino se toma las medidas necesarias para poder garantizar su protección, generara a un futuro no muy lejano se podrá en riesgo la producción agrícola por la falta de tierras que cumplan con este tipo de características adecuadas para producir alimentos para el hombre.

It was possible to show that in the San Sebastián district the urbanization process increased in a very accelerated way which, if an adequate urbanization process is not carried out respecting established parameters, this will generate negative impacts on said District. A negative consequence of urban growth is overpopulation and depletion of natural resources, which is the product of a poor distribution of the territory. It was observed that the agricultural area has declined markedly in recent years, generated by uncontrolled urban growth, ignorance on the part of people, the bad practice of our society of not respecting environmental and criminal regulations, causes this type of problems As it arises, this problem is also caused by the lack of interest of the competent authorities in charge of protecting and ensuring the protection of this type of land, which is of the utmost importance to human beings. In conclusion, this research will allow the generation of accurate and updated information to develop concise and viable proposals in the field of environmental and territorial sustainability of the District of San Sebastián, department of Cusco. As well as, disseminating the importance and economic value of this type of land destined for agricultural activity, which if the necessary measures are not taken to guarantee its protection, will generate in the not-too-distant future agricultural production may be at risk. due to the lack of lands that meet this type of suitable characteristics to produce food for man.
