La presente tesis realizó la descripción de la regulación del síndrome de alienación parental en
la suspensión de la patria potestad en la región del Cusco, para describir esta regulación se
planteó la siguiente interrogante, ¿Cómo es la regulación del síndrome de alienación parental
en la suspensión de la patria potestad en la región del Cusco 2021? por ende, como objetivo
general se planteó describir regulación del síndrome de alienación parental en la suspensión de
la patria potestad en la región del Cusco 2021. En la metodología, se utilizó el enfoque que
viene a ser cualitativo, el tipo de investigación es descriptivo, donde se describe la categoría y
sus subcategorías; la población de estudio está conformada por Jueces y fiscales vinculados al
tema en la región Cusco 2021; en la técnica utilizamos la entrevista y en los instrumentos la
guía de entrevistas y la libreta de campo. Se aplicó un diseño no experimental, en la cual
participaron Jueces y fiscales vinculados al tema en la región Cusco 2021, para ello se utilizó
como instrumento una entrevista.
En los resultados se muestra que la “la regulación del síndrome de alienación parental” se
presenta de manera evidente al resulta necesaria debido al incremento de casos en nuestro
sistema de justicia de menores que presentan el Síndrome de Alienación Parental ya que según
la presente investigación esta problemática debería de ser considerado como una forma de
maltrato psicológico debido a la importancia que radica en ella, siendo evidente la falta de una
regulación sobre el tema, resultando en una problemática a nivel nacional, por lo cual se plantea
la presente investigación. The present thesis made the description of the regulation of the parental alienation syndrome
in the suspension of parental authority in the Cusco region, to describe this regulation the
following question was raised, how is the regulation of the parental alienation syndrome in the
suspension of parental authority in the Cusco region 2021? Therefore, as a general objective,
it was proposed to describe the regulation of the parental alienation syndrome in the suspension
of parental authority in the Cusco region 2021. In the methodology, the approach that comes
to be qualitative was used, the type of research is descriptive, where the category and its
subcategories are described; The study population is made up of Judges and prosecutors linked
to the issue in the Cusco 2021 region; In the technique we use the interview and in the
instruments the interview guide and the field notebook. A non-experimental design was
applied, in which Judges and prosecutors linked to the issue in the Cusco 2021 region
participated, for this an interview was used as an instrument.
The results show that the “regulation of parental alienation syndrome“ is clearly presented as
it is necessary due to the increase in cases in our juvenile justice system that present the Parental
Alienation Syndrome since, according to the present investigation, this Problem should be
considered as a form of psychological abuse due to the importance that lies in it, being evident
the lack of a regulation on the subject, resulting in a problem at the national level, for which
the present investigation is proposed.
