Limitaciones registrales derivadas del régimen de co-propiedad: caso parcela 82 del distrito de san Jerónimo - Cusco

Abstract

A lo largo de la historia, se ha podido evidenciar que el derecho de propiedad, es uno de los derechos cuya repercusión ha trascendido no solo en el sector jurídico, sino en el económico y social, ello debido a múltiples factores. La presente investigación tiene un alto valor teórico pues de sus resultados se podrán contar con un estudio sistematizado sobre las limitaciones registrales derivadas del régimen de copropiedad: teniendo como caso el predio denominado Parcela 82 ubicado en el distrito de San Jerónimo provincia y departamento del Cusco, inscrito en la Zona Registral X – Sede Cusco bajo la partida N° 11139072,advirtiendo primeramente que la constitución del régimen de copropiedad de predios que se encuentran inscritos, se hace únicamente en vela de obtener seguridad jurídica en el modo de adquisición y transferencia del derecho de propiedad de cada copropietario, dejando de lado las limitaciones registrales que de esta derivaran, En el caso concreto en la Parcela 82, el tratamiento registral, a la fecha de la presente investigación, solo ha sido materializada en la inscripción de actos de transferencia de cuotas ideales o derechos y acciones, más no de otros actos o derechos inscribibles tales como habilitaciones urbanas, independizaciones, declaratorias de fábrica, derecho de superficie, entre otros, como consta en los asientos registrales.

Throughout history, it has become evident that the right to property is one of the rights whose impact has transcended not only in the legal sector, but also in the economic and social sectors, due to multiple factors. The present research has a high theoretical value because its results will provide a systematized study on the registry limitations derived from the co-ownership regime: Taking as a case the property called Parcel 82 located in the district of San Jeronimo, province and department of Cusco, registered in the Registry Zone X - Cusco Headquarters under item N° 11139072, warning firstly that the constitution of the co- ownership regime of properties that are registered, is only done in order to obtain legal security in the way of acquisition and transfer of the right of ownership of each co-owner, leaving aside the registry limitations that derive from this, In the specific case of Parcel 82, the registry treatment, as of the date of this investigation, has only been materialized in the registration of acts of transfer of ideal quotas or rights and shares, but not of other registrable acts or rights such as urban habilitations, independizations, declarations of factory, surface rights, among others, as shown in the registry entries.
