dc.description.abstractLa presente investigación tuvo por objetivo general, analizar la eficacia de los mecanismos para garantizar el cumplimiento de las sentencias de alimentos de menores de edad en relación a la Tutela Judicial Efectiva y Principio del Interés Superior del Niño y Adolescente, en el Primer Juzgado de Paz Letrado del distrito de Santiago, Cusco, 2018. Los objetivos específicos están referidos a la identificación de los mecanismos legales para garantizar el cumplimiento de las sentencias de alimentos e identificación de los principales factores de la ineficacia de los mecanismos para garantizar el cumplimiento de las sentencias de alimentos de menores de edad en relación a la Tutela Judicial Efectiva y Principio del Interés Superior del Niño y Adolescente, en el Primer Juzgado de Paz Letrado del distrito de Santiago, Cusco, 2018. Se postuló como hipótesis general que: “Los mecanismos para garantizar el cumplimiento de las sentencias de alimentos de menores de edad, en relación a la Tutela Judicial Efectiva y Principio del Interés Superior del Niño y Adolescente en el distrito de Santiago, Cusco, 2018; no son eficaces”. Dentro del marco teórico se desarrolló y analizó teoría pertinente de Derecho de Familia –Alimentos, Tutela Jurisdiccional efectiva y Principio de Protección del interés superior del niño. La investigación fue cualitativa documental, la discusión de los resultados se realizó a través de la argumentación jurídica en base a los datos teóricos y fácticos. Las hipótesis fueron validadas, y la principal conclusión fue: “Los mecanismos para garantizar el cumplimiento de las sentencias de alimentos de menores de edad, en relación a la Tutela Judicial Efectiva y Principio del Interés Superior del Niño y Adolescente en el distrito de Santiago, Cusco, 2018; son relativamente eficaces”. La recomendación fundamental está dirigida al Ministerio de Justica, en el sentido de implementar políticas de estado para reforzar su papel de garante del derecho de alimentos, a través de charlas informativas, motivadoras y sobretodo educativas en relación al rol de los padres en el cuidado y alimentación de sus hijos.es_PE
dc.description.abstractThe general objective of this research was to analyze the effectiveness of the mechanisms to guarantee compliance with child support sentences in relation to Effective Judicial Protection and the Principle of the Superior Interest of Children and Adolescents, in the First Court of the Peace Lawyer of the district of Santiago, Cusco, 2018. The specific objectives are related to the identification of the legal mechanisms to guarantee compliance with the food sentences of minors that are applied in the First Legal Peace Court of the district of Santiago, Cusco, 2018, and identification of the main factors of the ineffectiveness of the mechanisms to guarantee compliance with child support sentences in relation to Effective Judicial Guardianship and the Principle of the Higher Interest of Children and Adolescents, in the First Legal Peace Court of the district of Santiago, Cusco, 2018. It was postulated as a general hypothesis that: “The mechanisms to guarantee compliance with the food sentences of minors, in relation to the Effective Judicial Protection and Principle of the Superior Interest of the Child and Adolescent in the district of Santiago, Cusco, 2018; they are not effective”. Within the theoretical framework, pertinent theory of Family Law - Food, Effective Jurisdictional Guardianship and Principle of Protection of the best interests of the child - was developed and analyzed. The research was qualitative documentary, the discussion of the results was carried out through legal argumentation based on theoretical and factual data. The hypotheses were validated, and the main conclusion reached was: “The mechanisms to guarantee compliance with the child support sentences, in relation to the Effective Judicial Guardianship and the Principle of the Superior Interest of the Child and Adolescent in the district of Santiago, Cusco, 2018; they are relatively effective”. The fundamental recommendation is directed to the Ministry of Justice, in the sense of implementing state policies to reinforce its role as guarantor of the right to food, through informative, motivational and above all educational talks in relation to the role of parents in caring for and feeding their children.en_US
