La vulneración del principio superior del niño por la falta de veracidad en las declaraciones juradas en los procesos de alimentos en el juzgado de paz letrado de la provincia de Canchis, periodo 2018

El presente trabajo de investigación, se refiere la vulneración del Interés Superior del
Menor, en los procesos de alimentos, como consecuencias las declaraciones juradas que carecen
de veracidad. Estudio que se llevó a cabo dentro de los juzgados de paz letrados de la provincia
de Canchis en el periodo del 2017 al 2018, tomando como base referencial o de muestreo a los
procesos conocidos en dichos juzgados. Se realizaron entrevistas a los magistrados de los casos
con cuestionarios de 6 preguntas, situación que resulta medular para poder llegar a demostrar
nuestras hipótesis y realizar nuestro objetivo de investigación, siguiendo un enfoque cuantitativo
y teniendo un alcance descriptivo, lo cual, a su vez nos permitió llegar a los resultados mediante
análisis realizado a las entrevistas. El estudio de casos abordo 60 expedientes todos del Primer
y Segundo Juzgados de Paz Letrado del Poder Judicial de la provincia de Canchis, de los cuales
se hizo un estudio en cuanto al análisis de la veracidad fáctica de las declaraciones juradas
presentadas por los demandados en los procesos de alimentos consecuentemente con un análisis
de las sentencias emitidas en base a qué criterios asumió el juzgador para considerar la validez
y procedencia de la declaración jurada. En el desarrollo de la presente investigación
corroboramos la relación entre una declaración jurada realizada por el deudor alimentario y la
vulneración del Interés Superior del Menor, debido que si las declaraciones juradas no se les da
la importancia que ellas merecen seguirán vulnerando los derechos del menor alimentista en
cuanto a percibe una pensión equitativa y justa para poder cubrir sus necesidades primordiales
y poderse desarrollar de mejor manera dentro de la sociedad; y evitar que se sigan vulnerando
los derechos de los menores alimentistas. The present investigation work refers to the violation of the Best Interest of the Minor, in the
food processes, as consequences the sworn declarations that lack truthfulness. Study that was
carried out within the legal courts of peace of the province of Canchis in the period from 2017
to 2018, taking as a reference or sampling basis the processes known in said courts. Interviews
were conducted with the magistrates of the cases with 6-question questionnaires, a situation that
is central to being able to demonstrate our hypotheses and carry out our research objective,
following a quantitative approach and having a descriptive scope, which, in turn, It allowed to
reach the results by means of analysis carried out at the interviews. The case study covered 60
files, all of the First and Second Legal Magistrates' Courts of the Judicial Power of the province
of Canchis, of which a study was made regarding the analysis of the factual veracity of the sworn
statements presented by the defendants in the maintenance processes consequently with an
analysis of the sentences issued based on what criteria the judge assumed to consider the validity
and origin of the sworn statement. In the development of this investigation, we corroborate the
relationship between an affidavit made by the maintenance debtor and the violation of the Best
Interest of the Minor, because if the affidavits are not given the importance they deserve, they
will continue to violate the rights of the minor child. as for receiving an equitable and fair
pension to be able to cover their basic needs and to be able to develop better within society; and
prevent further violations of the rights of food minors.
