dc.description.abstractLa presente investigación “vulneración del derecho a la estabilidad laboral en los contratos modales”, tiene como propósito el de conocer si en las celebraciones de contratos modales suscritos por las Instituciones del Estado se vulnera o no el Derecho Fundamental de los trabajadores a gozar de la estabilidad laboral contemplado en el Art. 27 de la Constitución Política del Perú, ya en nuestro país se va incrementado la utilización de este tipo de contratos, debido a que la legislación nacional presenta una apuesta abierta y flexible para su utilización. En ese sentido, nos planteamos como objetivos específicos: Conocer las principales causas que conllevan a las Instituciones del estado a optar por la celebración de contratos modales, así como el de determinar cuáles son los principales efectos de las mismas. Conocer la naturaleza jurídica de los contratos sujetos y del derecho fundamental a la estabilidad laboral. El tipo de la investigación es socio jurídica, la misma que busca el estudio de la Ley de Productividad y Competitividad Laboral que regula los contratos sujetos a modalidad. El nivel de investigación es descriptivo, que se centra en explicar porque ocurre un fenómeno y en qué condiciones se manifiesta, y porque se relacionan dos o más variables. La presente investigación se empleará el enfoque de investigación cualitativa, ya que se enfoca en comprender los fenómenos explorándolos desde la perspectiva de lo aplicado en la realidad y la relación del contexto. Para demostrar la hipótesis planteada se utilizará como instrumentos al análisis de Sentencias expedidas por el Tribunal Constitucional y entrevistas a especialistas en derecho.es_PE
dc.description.abstractThe present investigation “violation of the right to work stability in modal contracts“, its purpose is to know whether or not the fundamental right of workers to enjoy the stability of work provided for in Art. 27 of the Constitution of Peru, already in our country the use of this type of contract is increasing, because the national legislation presents an open and flexible bet for its use. In this sense, we set as specific objectives: To know the main causes that lead the state institutions to opt for the conclusion of modal contracts, as well as to determine what are the main effects of the same. To know the legal nature of the subject contracts and the fundamental right to job stability. The type of research is sociojuridical, the same one that seeks the study of the Law of Productivity and Labor Competitiveness that regulates the contracts subject to modality. The level of research is descriptive, which focuses on explaining why a phenomenon occurs and under what conditions it manifests, and why two or more variables are related. The present research will use the qualitative research approach, since it focuses on understanding phenomena by exploring them from the perspective of what is applied in reality and the relationship of the context. In order to demonstrate the hypothesis presented, it will be used as instruments to analyse the judgments issued by the Constitutional Court and interviews with legal specialists.es_PE
