El presente trabajo de investigación tuvo como objetivo determinar la influencia de la reforma
constitucional del artículo 50 de la Constitución Política del Perú, referente al concordato
entre la Iglesia Católica y el Estado Peruano. La finalidad fue revisar y analizar los puntos
más relevantes y convenientemente revisables, para generar la posibilidad de reforma
constitucional del articulo 50 referente al concordato entre el estado peruano y la iglesia
católica.
La metodología que se utilizo fue no experimental puesto que no se manipula ninguno de las
variables, Longitudinal, porque se analiza aquellos puntos que nos permita conocer los hechos
de la realidad. El tipo de investigación es Descriptivo. - Propositivo. - porque, al final plantea
una propuesta de reforma constitucional.
Las conclusiones a las que se llegó son; El derecho a la dignidad consiste en que el ser
humano viene a ser el fin supremo del Estado y la Sociedad; el Derecho a la Igualdad consiste
en que toda persona, independientemente a diferencia de situaciones económicas, culturales,
religiosas, étnicas, etc., debe ser tratada de forma igualitaria, es decir sin ninguna
discriminación, y; el derecho a la Libertad que consiste en la facultad connatural que tiene el
ser humano de actuar según su libre albedrío, tal como lo prescribe el Art. 1, 2 num.2 y 3,
respectivamente, de la Constitución Política del Perú.
Las circunstancias reales de vida que sustentan la Constitución política de 1993, han variado
radicalmente. Eso se evidencia en el Artículo 50° de la Constitución Política del Perú que
desarrolla dos supuestos de hecho. 1) La colaboración incondicional estatal para el
afianzamiento, practica y razón de ser de la Religión Católica; 2) La colaboración condicional
del Estado a otros credos religiosos a pesar de los grandes cambios surgidos desde el año
1980 en los diferentes movimientos religiosos. La modificación debe tener en cuenta 3
principios.1) Que todas las confesiones religiosas incluida la Religión Católica reciban el
mismo tratamiento jurídico institucional de parte del Estado. 2) Que el debate constitucional
respecto a si la Religión Católica o cualquier religión es más principista que otra, ergo, reciba
un tratamiento privilegiado de parte del Estado, se cierra de forma categórica cuando se
declara al Estado Peruano como un Estado de naturaleza Laica. 3) Si bien es cierto que la
libertad de culto es un derecho fundamental, los estados modernos y democráticos no se deben dar el lujo de regular en un artículo constitucionales asuntos religiosos debido a que
esta forma cultural ya no es una práctica social actual. The present research work aimed to determine the influence of the constitutional reform of
article 50 of the Political Constitution of Peru, referring to the concordat between the Catholic
Church and the Peruvian State. The purpose was to review and analyze the most relevant and
conveniently reviewable points, to generate the possibility of constitutional reform of Article
50 regarding the concordat between the Peruvian state and the Catholic Church.
The methodology that was used was non-experimental since none of the variables is
manipulated, Longitudinal, because those points that allow us to know the facts of reality are
analyzed. The type of research is Descriptive. - Purposeful. - because, in the end, it raises a
proposal for constitutional reform.
The conclusions reached are; The right to dignity consists in the fact that the human being
becomes the supreme goal of the State and Society; The Right to Equality consists in that
every person, regardless of economic, cultural, religious, ethnic, etc. situations, must be
treated equally, that is, without any discrimination, and; the right to Freedom, which consists
of the innate power that human beings have to act according to their free will, as prescribed in
Art. 1, 2 num.2 and 3, respectively, of the Political Constitution of Peru.
The real life circumstances that sustain the 1993 Political Constitution have changed radically.
This is evidenced in Article 50 of the Political Constitution of Peru, which develops two
factual assumptions. 1) The unconditional collaboration of the state for the consolidation,
practice and reason of being of the Catholic Religion; 2) The conditional collaboration of the
State with other religious creeds despite the great changes that have arisen since 1980 in the
different religious movements. The modification must take into account 3 principles. 1) That
all religious confessions including the Catholic Religion receive the same institutional legal
treatment from the State. 2) That the constitutional debate regarding whether the Catholic
Religion or any religion is more principled than another, ergo, receives privileged treatment
from the State, is categorically closed when the Peruvian State is declared as a State of
Secular nature. 3) Although it is true that freedom of worship is a fundamental right, modern
and democratic states should not have the luxury of regulating religious matters in a
constitutional article because this cultural form is no longer a current social practice.
