dc.description.abstract | Tenemos por cuenta que los sujetos actuantes dentro de una relación laboral
tanto el empleador como el trabajador, son sujetos que se encuentran dentro de una
relación contractual, mediante la cual se fijan las condiciones laborales, las mismas que
en sentido estricto deberían estar enmarcadas dentro de la legislación laboral vigente,
de este modo entendemos que con la suscripción del contrato queda consagrado el
acuerdo de voluntades de ambas partes; sobre esa línea de ideas, se entendería que todo
lo pactado en el contrato laboral debería ser de obligatorio cumplimiento, y por ninguna
razón se podrían realizar cambios unilaterales al contrato, y sobre este último punto es
que versa el presente trabajo de investigación; esa potestad facultativa de la que goza el
empleador de poder realizar modificaciones al contrato de forma unilateral, siempre que
estos obedezcan a una necesidad justificada de la empresa.
El Decreto Legislativo N° 728, es el cuerpo legal que otorga dicha facultad al
empleador, facultad que cuenta con limites en su ejercicio ya que para su ejercicio deben
de configurarse dos requisitos previos, que se produzca dentro de los criterios de
razonabilidad y que responda a necesidades fundadas de la empresa, de modo que no es
posible que el empleador pueda ejercer esta potestad sin ningún control, por el contrario,
el presente trabajo de investigación tiene por finalidad proponer la incorporación
legislativa del “cuestionamiento al uso del Ius Variandi”, con el único fin de poder
conocer las razones que motivan los cambios unilaterales del contrato, más
específicamente los cambios geográficos del lugar de trabajo, el cual debe estar
debidamente sustentado en la razonabilidad y necesidad justificada de la empresa. De
modo que cual variación contractual, ya sea en el cambio de funciones, funciones
adicionales, horario de trabajo y entre otros que no supongan un perjuicio para el
trabajador, tendrían que estar sustentados a necesidades urgentes de la empresa y no
solo a una disposición por parte del empleador, o jefe inmediato. | es_PE |
dc.description.abstract | We take into account that the subjects acting within an employment relationship,
both the employer and the worker, are subjects that are within a contractual relationship,
by means of which the working conditions are established, which strictly should be
framed within current labor legislation, in this way we understand that the agreement of
wills of both parties is enshrined with the signing of the contract; on that line of ideas, it
would be understood that everything agreed in the labor contract should be mandatory,
and for no reason could unilateral changes be made to the contract, and on this last point
is that this research work is about; that optional power that the employer enjoys being
able to make modifications to the contract unilaterally, provided that these obey a justified
need of the company.
Legislative Decree No. 728, is the legal body that grants such power to the
employer, which has limits in its exercise since two prerequisites must be configured for
its exercise, which occurs within the criteria of reasonableness and responds to the
founded needs of the company, so that it is not possible for the employer to exercise this
power without any control, on the contrary, this research work aims to propose the
legislative incorporation of the “questioning of the use of the Ius Variandi”, with the sole
purpose of being able to know the reasons that motivate the unilateral changes of the
contract, more specifically the geographical changes of the workplace, which must be
duly based on the reasonableness and justified need of the company. So that any
contractual variation, whether in the change of functions, additional functions, working
hours and among others that do not cause harm to the worker, would have to be supported
by urgent needs of the company and not only by a provision for part of the employer, or
