dc.description.abstract | El presente trabajo de investigación “Debido Proceso, Plazo Razonable y su
vulneración en la Investigación Preliminar del Proceso Penal en el distrito de Santa Ana,
provincia de La Convención, de la región Cusco, en el año 2019” desarrollamos temas de
relevancia jurídica. Como el Debido Proceso en términos generales que viene a ser el
juicio justo ante el Juez, respetando las garantías fundamentales evitando así el abuso de
una autoridad, siendo resueltos, estos dentro de un Plazo Razonable que se encuentra
regulado en la Declaración Universal de los Derechos Humanos y de más tratados
internacionales, este Plazo Razonable viene a ser el tiempo o duración del proceso penal,
con la entrada en vigencia del Nuevo Código Procesal Penal a través del Decreto
Legislativo 957, que fue publicado el 29 de julio de 2004, se estableció que el plazo para
las diligencias preliminares era de 20 días naturales, días dados para las diligencias
preliminares tenían una apertura infinita a razón de que señalaba que fiscal podría
modificar este plazo.
Este acto de vulneración al Debido Proceso, Plazo Razonable en la Investigación
Preliminar del Proceso Penal en el distrito de Santa Ana, provincia de La Convención, de
la región Cusco, en el año 2019; respecto a la investigación preliminar tenemos la
CASACIÓN 02-2008 LA LIBERTAD, la CASACIÓN N° 144-2012, ANCASH y ahora
último de la CASACIÓN 599-2018, LIMA en el caso Keiko Sofía Fujimori Higuchi en
donde señala que por ser un caso de crimen organizado el plazo para dichas diligencias
preliminares vendría a ser 36 (treinta y seis) meses. Casaciones que sirven de precedente
para que los operadores del Ministerio Público tengan dentro de sus oficinas carpetas fiscales sin el impulso correspondiente hasta el vencimiento de estos plazos dados por las
casaciones en mención, hecho que es avizorado en todos los distritos fiscales del Perú,
del mismo este hecho se puede apreciar en la Fiscalía Provincial Corporativa de la
