Naturaleza colusoria de las adendas de los contratos en la Carretera Interoceánica Sur

Abstract

El presente investigación titula NATURALEZA COLUSORIA DE LAS ADENDAS DE LOS CONTRATOS EN LA CARRETERA INTEROCEÁNICA SUR en la cual se tiene como objetivo principal determinar si las adendas procedimentales suscritas entre el Estado peruano y la empresa ODEBRECHT en la ejecución de la carretera interoceánica sur tuvieron naturaleza colusoria la investigación es pertinente ya que se orienta a describir la naturaleza colusoria de las adendas procedimentales suscritas entre el Estado Peruano, y la Empresa ODEBRECHT durante la ejecución de la carretera interoceánica sur a partir de la investigación que hicieran Francisco Durand, y Emilio Salcedo sobre la captura del Estado, la colusión y corrupción en tres megaproyectos de infraestructura pública desde las ciencias sociales, existiendo la necesidad de complementar con el enfoque jurídico estas investigaciones, de acuerdo a la metodología se aplicó el tipo de investigación descriptivo- explicativo de diseño descriptivo, secuencial, la población de estudio son las adendas suscritas entre el estado peruano y actos funcionarios de la empresa mencionada, y sus socias peruanas y brasileñas para la ejecución de la carretera interoceánica sur, el análisis de los procesos de contratación de la carretera interoceánica sur y sus tramos, En la presente investigación se ha podido comprobar la concertación entre los altos funcionarios del Estado Peruano y los funcionarios de la empresa constructora ODEBRECHT; a través del favorecimiento en la adjudicación de la IIRSA SUR en el tramo 2 y 3; proyecto que fue considerado como obra de necesidad pública, además se exonero al postor con algunas prohibiciones para contratar con el Estado peruano: como tener un proceso judicial vigente; sobre este extremo y tomando en consideración el Informe de la Primera Comisión Lava jato presidida por el Congresista Parí, el consorcio conformado por Norberto ODEBRECHT, Graña & Montero tenían procesos judiciales con el Estado Peruano; sin embargo, se les llego a adjudicar la construcción de los tramos antes referidos en la IIRSA SUR.
