Control judicial en la administración de la pensión mensual de alimentos y eficaz protección del interés superior del niño y adolescente en el primer juzgado de paz letrado de Wanchaq - Cusco año 2019

Abstract

La presente investigación tuvo por objetivo general: ―Determinar si es necesario establecer un control judicial en la administración de la pensión mensual de alimentos para garantizar una eficaz protección del interés superior del niño y adolescente en el 1° Juzgado de Paz Letrado de Wanchaq, Cusco, 2019‖. El objetivo específico está referido a: ―Establecer cuáles son los efectos de un control judicial en la administración de la pensión mensual de alimentos en relación a una eficaz protección del interés superior del niño y adolescente en el 1° Juzgado de Paz Letrado de Wanchaq, 2019‖. Se postuló como hipótesis general que: ―Es necesario establecer un control judicial en la administración de la pensión mensual de alimentos para garantizar una eficaz protección del interés superior del niño y adolescente en el Primer Juzgado de Paz Letrado de Wanchaq, Cusco, 2019‖. La investigación fue cualitativa documental de alcance jurídico explicativo. La discusión de los resultados se realizó a través de la argumentación jurídica. Las hipótesis fueron validadas, y la principal conclusión fue la siguiente: ―Es necesario establecer un control judicial en la administración de la pensión mensual de alimentos para garantizar una eficaz protección del interés superior del niño y adolescente en el Primer Juzgado de Paz Letrado de Wanchaq, Cusco, 2019. La recomendación fundamental está referida a la incorporación de mecanismos legales en el mismo proceso de alimentos de menor de edad para que en los casos en los que el demandado cumpla oportunamente con la pensión de alimentos a su pedido se pueda disponer que la parte demandante exhiba la documentación correspondiente que permita verificar si la administración de la pensión de alimentos se destina completa, eficaz y oportunamente para satisfacer las necesidades del alimentista.

The general objective of the present investigation was: “Determine if it is necessary to establish a judicial control in the administration of the monthly food allowance to guarantee an effective protection of the best interest of the child and adolescent in the 1st Court of Peace of Wanchaq, Cusco, 2019“. The specific objective is referred to: “To establish what are the effects of a judicial control in the administration of the monthly food pension in relation to an effective protection of the best interests of the child and adolescent in the 1st Wanchaq Law of Peace Law, 2019.“ It was postulated as a general hypothesis that: “It is necessary to establish a judicial control in the administration of the monthly food allowance to guarantee an effective protection of the best interests of the child and adolescent in the First Court of Peace of Wanchaq, Cusco, 2019“. The research was documentary qualitative of explanatory legal scope. The discussion of the results was made through legal argumentation. The hypotheses were validated, and the main conclusion was the following: “It is necessary to establish a judicial control in the administration of the monthly food pension to guarantee an effective protection of the best interests of the child and adolescent in the First Court of Peace Wanchaq, Cusco, 2019. The fundamental recommendation is referred to the incorporation of legal mechanisms in the same food process of minor so that in the cases in which the defendant timely fulfills the maintenance of his request, it can be arranged that the plaintiff exhibits the corresponding documentation that allows verifying if the administration of the maintenance of food is destined complete, effective and opportunely to satisfy the needs of the alimentary one.
