dc.description.abstractEl problema de la investigación radica en la posibilidad de la aplicación del proceso especial de terminación anticipada durante la Etapa Intermedia del proceso penal común, ya que por un lado se tiene una postura que sostiene, si es factible su aplicación, en razón de una interpretación teleológica del proceso penal, y la oportunidad de la misma es hasta antes de iniciarse la oralización del requerimiento acusatorio; y, en contraposición a esta, existe una postura contraria a ella, que sostiene que es imposible su aplicación, por carecer de fundamento jurídico y de aplicarse se desnaturaliza todo el proceso penal. El OBJETIVO de la presente investigación, es analizar la problemática para uniformizar la jurisprudencia en torno a la aplicación del proceso especial de terminación anticipada en la etapa intermedia; la MEDOTODOLOGIA de la presente investigación es de tipo cualitativo y tiene un diseño dogmático; asimismo los RESULTADOS de la presente investigación, en un primer lugar están dirigidos a uniformizar la jurisprudencia en torno a la aplicación del proceso especial de terminación anticipada en la etapa intermedia; y en segundo lugar, en establecer un marco normativo que precise que su aplicación proceda hasta antes de la oralización del requerimiento acusatorio.es_PE
dc.description.abstractThe problem of the investigation lies in the possibility of applying the special process of early termination during the Intermediate Stage of the common criminal process, since on the one hand there is a position that maintains, if its application is feasible, by reason of an interpretation teleological of the criminal process, and the opportunity of the same is until before the oralization of the accusatory requirement begins; and, in contrast to this, there is a position contrary to it, which maintains that its application is impossible, because it lacks a legal basis and if applied, the entire criminal process is distorted The OBJECTIVE of this investigation is to analyze the problem to standardize the jurisprudence around the application of the special process of early termination in the intermediate stage; The MEDOTODOLOGY of the present investigation is of a qualitative type and has a dogmatic design; likewise, the RESULTS of this investigation, in the first place, are aimed at standardizing the jurisprudence regarding the application of the special process of early termination in the intermediate stage; and secondly, to establish a regulatory framework that requires that its application proceed before the oralization of the accusatory requirement.en_US
